PETITION FOR THE CREATION OF THE MISSION VIEJO LIBRARY GENERAL IMPROVEMENT DISTRICT (NO.

1-2011) The undersigned Petitioners, constituting not less than 30% or 200 of the electors, whichever is lower, of the proposed district hereinafter described, present this Petition for the organization of a general improvement district, in accordance with the provisions of Title 31, Article 25, Part 6 of the Colorado Revised Statutes, and Chapter 118, Article III of the City Code of the City of Aurora, Colorado (the "City"). Pursuant to Section 31-25-604, C.R.S. and Section 118-127 of the City Code, and in support of the Petition, the undersigned state: 1. The name of the proposed district is "Mission Viejo Library General Improvement District (No. 1-2011)" (the "District"), which District is located entirely within the boundaries of the City. 2. The District will provide continuing public library services and improvements at the Mission Viejo Library, located at 15324 E. Hamden Circle, Aurora, CO 80013, within and for the District. Working in partnership with the City, it is the intent of the petitioners that the District will improve existing library facilities, increase hours of operation, and provide enhanced library services, such as buying new books and media and improving programs for children, teens, and adults. 3. The estimated annual cost of the services to be provided and the improvements to be acquired, constructed, installed, operated and/or maintained by the District is approximately ________________________ Dollars ($____________). 4. WHEREFORE, the Petitioners respectfully request that the City of Aurora adopt an ordinance pursuant to 31-25-607(4), C.R.S.: A. Finding that the Petition for organization of the District has been duly signed and presented in conformity with Title 31, Article 25, Part 6, C.R.S., and Chapter 118, Article III of the City Code; B. C. Finding that the allegations of the petition are true; Adjudicating all questions of jurisdiction; and

D. Ordering the question of organization of said District and any questions concerning the imposition of an ad valorem property tax mill levy, or any question or questions otherwise necessary to implement the provisions of Section 20 of Article X of the Colorado Constitution be certified for the November ___, 2011 regular municipal election.

FULL TEXT OF PROPOSED MEASURE: MISSION VIEJO LIBRARY GENERAL IMPROVEMENT DISTRICT SHALL THE MISSION VIEJO LIBRARY GENERAL IMPROVEMENT DISTRICT BE ORGANIZED IN THE CITY OF AURORA, COLORADO, AND SHALL DISTRICT TAXES BE INCREASED NOT TO EXCEED $750,000 ANNUALLY, PAYABLE COMMENCING IN 2012, BY AN AD VALOREM PROPERTY TAX MILL LEVY IMPOSED AT A RATE SUFFICIENT TO PRODUCE THE ANNUAL REVENUES SPECIFIED ABOVE, WHICH IN 2011, IS APPROXIMATELY $25 PER YEAR ON A $200,000 HOME, ALL TO PROVIDE FOR THE FOLLOWING SERVICES: PUBLIC RESTORING, MAINTAINING, AND IMPROVING THE MISSION VIEJO LIBRARY SERVICES AND FACILITIES; INCREASING LIBRARY SYSTEM HOURS OF OPERATION; RENOVATION OF THE FACILITY AND PROVIDING ENHANCED LIBRARY SERVICES, SUCH AS BUYING NEW BOOKS, LIBRARY LITERACY PROGRAMS AND MEDIA: PROVIDED THAT: (I),THE RATE OF SUCH TAX MAY BE ADJUSTED TO ACCOUNT FOR CHANGES IN LAW OR IN THE METHOD OF CALCULATING ASSESSED VALUATION SO THAT SUCH CHANGES WILL NOT IMPACT THE REVENUES GENERATED BY SUCH TAX AND (II) SUCH TAX SHALL BE SPENT AS A VOTER-APPROVED REVENUE CHANGE AND AN EXCEPTION TO ANY LIMITS THAT WOULD OTHERWISE APPLY UNDER THE CONSTITUTION AND LAWS OF THIS STATE AND THE AURORA CITY CHARTER (III) ANY INCREASE TO THE ANNUAL COSTS OF $750,000 MUST BE VOTER APPROVED.
