Thisactshallbeknownandmaybecitedasthe"Marriage2EqualityAct".3
§
2.Legislativeintent.Marriageisafundamentalhumanright.Same-4sexcouplesshouldhavethesameaccessasotherstotheprotections,5responsibilities,rights,obligations,andbenefitsofcivilmarriage.6Stablefamilyrelationshipshelpbuildastrongersociety.Forthe7welfareofthecommunityandinfairnesstoallNewYorkers,thisact8formallyrecognizesotherwise-validmarriageswithoutregardtowhether9thepartiesareofthesameordifferentsex.10Itistheintentofthelegislaturethatthemarriagesofsame-sexand11different-sexcouplesbetreatedequallyinallrespectsunderthelaw.12Theomissionfromthisactofchangestootherprovisionsoflawshall13notbeconstruedasalegislativeintenttopreserveanylegal14distinctionbetweensame-sexcouplesanddifferent-sexcoupleswith15respecttomarriage.Thelegislatureintendsthatallprovisionsoflaw16whichutilizegender-specifictermsinreferencetothepartiestoa17marriage,orwhichinanyotherwaymaybeinconsistentwiththisact,18beconstruedinagender-neutralmannerorinanywaynecessaryto19effectuatetheintentofthisact.20

3.Thedomesticrelationslawisamendedbyaddingtwonewsections2110-aand10-btoreadasfollows:22

10-a.Partiestoamarriage.1.Amarriagethatisotherwisevalid23shallbevalidregardlessofwhetherthepartiestothemarriageareof24thesameordifferentsex.252.Nogovernmenttreatmentorlegalstatus,effect,right,benefit,26privilege,protectionorresponsibilityrelatingtomarriage,whether27derivingfromstatute,administrativeorcourtrule,publicpolicy,28COmmonlaworanyothersourceoflaw,shalldifferbasedontheparties

12066-04-11tothemarriagebeingorhavingbeenofthesamesexratherthana2differentsex.Whennecessarytoimplementtherightsandresponsibil-3itiesofspousesunderthelaw,allgender-specificlanguageorterms4shallbeconstruedinagender-neutralmannerinallsuchsourcesof5law.6

10-b.Application.1.Notwithstandinganyotherprovisionoflaw,7pursuanttosubdivisionnineofsectiontwohundredninety-twoofthe8executivelaw,acorporationincorporatedunderthebenevolentorders9lawordescribedinthebenevolentorderslawbutformedunderanyother10lawofthisstateorareligiouscorporationincorporatedunderthe11educationlaworthereligiouscorporationslawsshallbedeemedtobe12initsnaturedistinctlyprivateandtherefore,shallnotberequiredto13provideaccommodations,advantages,facilitiesorprivilegesrelatedto14thesolemnizationorcelebrationofamarriage.152.Arefusalbyabenevolentorganizationorareligiouscorporation,16incorporatedundertheeducationlaworthereligiouscorporationslaw,17toprovideaccommodations,advantages,facilitiesorprivilegesin18connectionwithsectionten-aofthisarticleshallnotcreateacivil19claimorcauseofaction.203.Pursuanttosubdivisionelevenofsectiontwohundredninety-sixof21theexecutivelaw,nothinginthisarticleshallbedeemedorconstrued22toprohibitanyreligiousordenominationalinstitutionororganization,23oranyorganizationoperatedforcharitableoreducationalpurposes,24whichisoperated,supervisedorcontrolledbyorinconnectionwitha25religiousorganizationfromlimitingemploymentorsalesorrentalof26housingaccommodationsoradmissiontoorgivingpreferencetopersons27ofthesamereligionordenominationorfromtakingsuchactionasis
