asthattermhascometobeusedundertheEthicsinPublicServiceAct.Whilenoteveryparticularuseofeachstateresourcemayamounttoamajorviolation,thepatternofmisuseofofficeandstateresourcesovertheperiodofmanyyearsissubstantiial,andthetotalitycouldeasilyrepresenttensofthousandsofdollars
of
misusedstatetaxpayermoney(primarilyintheformofstatetime)spentonherpersonalbusinesses.Thatfactthatthesebusinessesaregenerallyregisteredasnon-profitsorthattheymayhavelaudablesocialgoalsisnoexcuseforexpendingstateresourcesthatwereappropriatedforDOCuse.

Moreover,IbelievethatMs.Stewart'sservingasasupervisorwithinDOtwhilealsocontrollingallofthesebusinessentitiesblurredthelinesamongDOCstaffandothersinthecriminaljusticecommunityinpreciselythemannerwhichourconflictofinterestlawsaremeanttoprevent.Simplyput,employeesandmembersofthecommunityshouldbeclearastowhenMs.StewartwasactingasaDOCofficer,andwhenshewasactingonbehalfofherownbusinesses.I

alegislativeethicsadviser(regularlyadvisinglegislatorsandstaffastoapplicationofethicslaw),toreviewthematerialsprovidedtomeandrenderanopinion.Basedonthisanalysis,IrespectfullysuggestthatMs.Stewart'sactionsviolatethefollowingpartsofChapter
52.52RCW:

persons,money,orpropertyforprivategain,RCW42.52.160.TheevidencepresentedsuggeststhatMs.Stewartregularlyusedstateresourcesfortheprivategainofherselfandherbusinesses.Inparticular,
it
appearsthatsheregularlyusedstateemployeesunderherdirectiontoworkonherprivatebusinesses.Shealsoregularlyusedherownstatetime,DOCfacilities,vehicles,computers,andotherstateresourcestobenefitherselfandherprivatebusinesses.3.Conflict
of
interest,RCW42.42.020--:040.TheevidencepresentedsuggeststhatMs.Stewart'sextensivemisuseofstateresourcesonbehalfofherselfandherprivatebusinesseswasincompatible'with
her
publicduties.
To
theextent
thatany
of
herbusinessescontractedwithDOCorreceivedDOCfunds,thismayalsobeaviolationoftheprohibitionsonhavinganinterestinstatefinancialtransactions.
It
ispossiblethat
the
activityofMs.Stewart,asoutlinedin
the
evidencepresented,mayviolateotherEthicsinPublicServiceActprovisions,WACs,DOCpolicies,orprecedentadoptedbytheBoard.III.SourcesofInformation
&
EvidenceIhavenofirsthandknowledgeofanyoftheseallegations.Ihave,whereappropriate
and
possible,triedtoconfirmcertainidentitiesorpublicly-availablebitsofinformation.AlloftheinformationonwhichIbasethiscomplaintwasprovidedtomeinmycapacityasamemberoftheSenateCommitteeonHumanServices
&
Corrections,whichnecessarilyhasoversightauthorityovertheDepartmentofCorrections.Inadlditiontothematerialsfurnishedwiththiscomplaint,IcanputyouincontactwiththecitizenswhofrrstbroughtthismattertomyattentionandprovidedwhatIbelievetobesignificantevidenceofsystematicEthicsinPublicServiceActviolationsoverthepastseveralyears.Thesecitizenshavefirsthandknowledgeofthefactswhichsupportthiscomplaint,andtheyarewillingtotestifyandprovideevidencetothe'Board,directly.Theycametomebecausetheywereuncertainastohowbesttogoaboutensuringthatthisinformationreach
