PUBLICHEARING:DEPARTMENT:HumanResourcesDYES0NO6INFORMATIONCONTACT:BenitaRansomHumanResourcesDirectorTTACHMENT:0YES0NOPAGES:PHONENUMBER:404-687-3588PURPOSE:AnordinancetoamendSection20-1,Section20-45,andSection20-165oftheCodeofDeKalbCounty,GeorgiasoastoimplementchangestoCountyannualleavepolicies--toreducemaximumannualleaveaccrual,carryover,andpayoutlimitsforthefuture.NEED/IMPACT:DeKalbCountyGovernmentneedstoreducetheexpenseassociatedwithemployeeannualleaveaccruals,carryoverlimits,andannualleavepayouts.Thecountymaysaveanestimated$10Millionovertheanticipatedfullcareertenureofemployeesfollowingrevisionofthesepolicies.Employeesaffectedbythechangesinthisordinancewillnotloseanycurrentleavebalancevaluebecauseofthesechanges.RECOMMENDATION(S):Therecommendationsincorporatefeedbackprovidedbyvariousemployeegroups.1)Modifymaximumannualleaveaccrualratefrom30daysperyearto27daysperyear,withthemaximumratereachedat20yearsserviceinsteadof25years.2)Eliminatethecurrentmaximumannualleaveyear-endcarryoverof60daysandimplement2tiersofmaximumannualleaveyear-endcarryoverbasedonyearsofservice:45daysmaximumcarryoverforemployeeswith10yearsormoreofservice.30daysmaximumcarryoverforemployeeswithlessthan10yearsofservice.Employeeswithannualleaveaccrualthatexceedsthenewmaximumyear-endcarryoverlimitsattheendof2011wouldnotlosethevalueoftheleavebalance.Employeeswillhavetwooptionswithrespecttoannualleavecarryoverunderthenewpolicy:
(1)
convertexcessannualleaveintosickleave,hourforhour;or
(2)
placeexcessannualleaveinareserveaccountwhichanyunusedportionwouldbepaidoutuponseparation,attheemployee'slast2011rateofpay.3)Reducemaximumaccumulatedannualleavepayoutatseparationfrom60daysto:45daysmaximumforemployeeswith10yearsormoreofservice30daysmaximumforemployeeswithlessthan10yearsofservice

ANORDINAl'1CETOAMENDTHECODEOFDEKALBCOUNTY,GEORGIA,CHAPTER20,ARTICLESI,IIANDVIII,TOCHANGETHE:vIAXIMUMANNUALLEAVEACCRUALRATE,REDUCEANNUALLEAVECARRYOVERLIMIT,REDUCEANNUALLEAVEPAYOUTLIMIT,ANDFOROTHERPURPOSES.WHEREAS,theGoverningAuthorityfindsitnecessarytoreducetheexpenseassociatedwithemployeeannualleaveaccruals,annualleavecarryoverlimits,andleavepayoutsforbudgetaryreasons;WHEREAS,asurveyofsevencomparablejurisdictionsrevealedDeKalbCounty'sleaveplanisgenerous;WHEREAS,thecountymaysaveanestimatedtenmilliondollarsovertheanticipatedfulltermcareerexpectancyofemployeesonaccountoftheseamendments;WHEREAS,feedbackfromvariousemployeegroupswassolicitedandincorporatedinthisordinance;andWHEREAS,employeeswillnotloseexistingleaveaccrualvalueasaresultoftheseamendments.NOW,THEREFORE,BEITORDAINEDbytheGoverningAuthorityofDeKalbCounty,Georgia,anditisherebyordainedbytheauthorityofsame,thatChapter20oftheCodeofDeKalbCounty,beandthesameisherebyamendedasfollows:

meansallperiodsofcountyemploymentduringwhichanemployeewaseligibletoaccrueannualleaveunderthischapter.

Bydeletingsubsection20-45(a)initsentiretyandsubstitutinginlieuthereofthefollowingnewsubsection(a)insection20-45:
(a)
Annualleavepayout.
Uponseparationfromemploymentwiththecounty,anemployeewhohascompletedatleastsix(6)monthsbutlessthanten(10)yearsofqualifyingservicemayreceivepayforaccumulatedunusedannualleaveuptoamaximumofthirty(30)daysattheemployee'sregularrateofpay.
An
employeewhohascompletedatleastten(10)yearsofqualifyingservicemay,uponseparationfromemploymentwiththecounty,receivepayforaccumulatedunusedannualleaveuptoamaximumofforty-five(45)daysattheemployee'sregularrateofpay.Nopaymentshallbemadeuponseparationfromemploymentforanyamountofaccumulatedunusedsickleave.(Note:UponretirementafterMay30,1996,accumulatedunusedsickleaveatthetimeofretirementshallbecreditedattherateoftwenty-oneandone/half(21112)daysforone-twelfthyearofservicetodeterminetotallengthofserviceforretirementbenefitcomputation).
Bydeletingsubsection20-45(b)initsentiretyandsubstitutinginlieuthereofthefollowingnewsubsection(b)insection20-45:
(b)
Annualleavepayout;deathofemployee.
Uponthedeathofapermanentemployee,thebeneficiaryofsuchemployeeshallbepaidforaccumulatedunusedannualleaveandanyotherfinalpayandallowancesinthemannerofotherseparationsasindicatedabove.
