Analysis of Election Expenses of MLAs in West Bengal 2011 Assembly Elections

Why election Expenses are important? 1. An analysis of expense statements of all newly elected MLAs is being done for the first time ever within the deadline of 45 days(from the date of declaration of results) during which the election of a candidate can be challenged on grounds of under-declaration of election expenses. 2. Since these results were declared on 13 May, the last date of such a challenge through an election petition will be 28 July 3. As per section 81 of the Representation of Peoples Act, any candidate or voter can file an election petition Highlights of this Report: Based on the election expense declarations of 217 newly elected MLAs of West Bengal to the ECI, the average amount of money spent by them in the elections is only about 7 lacs which is about 44% of the expense limit (16 lacs). The average election expense declared by MLAs party-wise for INCs 33 candidates was Rs 10,35,887 (10 Lacs+), for AITC's 129 candidates was Rs 7,06,881 (7 Lacs+) and for CPI(M)s 32 candidates was Rs 4,47,923 (4 Lacs+). 1 Independent candidates declared election expense was 15,21,610 (15 Lacs+). Only 6 MLAs have declared that they have spent more than 80% of the amount (i.e. over 13 lacs). A total of 147 MLAs have declared election expenses less than Rs 8 Lacs (that is less than 50% of Expense Limit set by ECI). (Detailed tables are given below) The maximum expense of 15,65,034 (15 Lacs+), has been declared by Smita Bakshi of All India Trinamool Congress from Jorasanko constituency, followed by Hamidul Rahman, an Independent from Chopra constituency (expense of around 15 lacs) and Amal Achargee of All India Trinamool Congress from Itahar constituency (expense of around 14 lacs). The minimum expense of 1,14,489 (1 Lac+) has been declared by Namita Saha of All India Trinamool Congress from Magrahat Purba constituency. She is followed by Kashinath Mishra of All India Trinamool Congress from Bankura constituency with election expense of around 1.3 lacs and Bulu Chik Baraik of Mal constituency with election expense around 1.4 lacs. Expense on Public Meetings and Processions: Out of all the 217 MLAs analyzed, 3 declared that they did not spend ANY amount on public meetings, processions etc. as per their election expenses. Expense on Campaigning through electronic/print media: 163 MLAs have declared that they did not spend ANY amount on campaigning through electronic/print media. 26 MLAs have spent less than 10 thousand on the same. Expense on Campaign Workers: 53 MLAs have declared that they did not spend ANY amount on Campaign workers. 26 MLAs have spent less than 10 thousand on the same.

Expense on Vehicles Used: 3 MLAs have declared that they did not spend ANY amount on vehicles used during campaign. Expense on Campaign Materials and Erection of gates, arches etc.: A total of 3 MLAs have declared that they did not spend ANY amount on erections of gates, arches, cutouts, banners and Campaign materials, like handbills, posters, video, audio cassettes, loudspeakers. The National Election Watch demands that the ECI should specifically investigate the election expenses of candidates who have declared very little or no expenses on use of vehicles, campaign material, public meetings, campaign workers and print/electronic media to check the verity of these disclosures. Kolkata /Delhi, June 25th, 2011: Association for Democratic Reforms (ADR) and National Election Watch (NEW), a nationwide campaign comprising of more than 1200 NGOs and other citizen led organizations, have been working on electoral reforms, improving democracy and governance in India. West Bengal Election Watch (WBEW) has analyzed the abstract statement of expenses of 217 MLAs out of the 294 who have won the West Bengal 2011 Assembly Elections. National Election Watch (NEW) analyzed the abstracts of election expenses submitted by 217 1 MLAs. This report is based on the analysis of the information provided by the MLAs and submitted to ECI. The Election Commission released expense abstract statements of the winners, first and second runners up of each state in the Chief Electoral Officer (CEO)s website. Analysis of the declarations of the MLAs for West Bengal (where the election expense limit stipulated by the ECI is 16 lakhs) revealed that only 6 MLAs have utilized above 80% of the expense limit amount stipulated by the ECI i.e. 6 persons have utilized about 13 lacs in the elections. The party-wise average election expense for all MLAs in total is only about 7 lacs which is 44% of the total expense limit set for West Bengal. This is interesting to note in the light of the fact that almost all parties have been lobbying for an increase in the expense limit for election expenses. Analysis of the details of expenses according to various items like vehicles used, expenses on campaign materials, banners etc. reveal some interesting facts: 3 MLAs have declared that they did not spend any amount on Public meetings and processions, 163 MLAs have declared that they did not spend ANY amount on campaigning through electronic/print media, 26 MLAs have spent less than 10 thousand on the same; 53 MLAs have not spent any amount on campaign workers, 3 MLAs declared that they did not spend any amount on vehicle use and 3 MLAs have declared that they did not spend ANY amount on erections of gates, arches, cutouts, banners and Campaign materials, like handbills, posters, video, audio cassettes, loudspeakers. West Bengal Assembly Elections, 2011 was held on April, 2011. West Bengal Election Watch and Association for Democratic reforms analyzed abstracts statement of election expenses of the MLAs of West Bengal 2011 Assembly. The report is based on the analysis of the same.

Top 5 MLAs with highest declared election expenses in 2011 Assembly Elections
Smita Bakshi of AITC who won from Jorasanko constituency has declared the highest election expenses of over 15 lacs which is 98% of the maximum amount that can be spent during elections. She is followed by Hamidul Rehman, an independent who won from Chopra constituency has declared expenses of approximately 15.21 lacs.

The lowest election expense was declared by Namita Saha of AITC who won from Magrahat Purba constituency who declared that she spent Rs. 1.14 lacs during elections which is 7% of the expense limit stipulated by ECI for West Bengal. She is followed by Kashinath Mishra from AITC who won from Bankura constituency. He declared Rs. 1.34 lacs as his election expenditure. The 5 lowest declared election expenditures are given below:
