WHEREAStheCourtatthehearingdirectedthepartiestomeetandconferaboutthe

timingofvariousproceduralmotionsthatStateFundandDPAintendedtofile;

WHEREASthepartieshavenowdonesoandhavereachedanagreementonanorderly

waytoproceedwiththesubjectmatterofthisdispute.Specifically,thepartieshaveagreedthat

CASEwillproceedwiththismatterthroughthegrievanceandarbitrationprovisionsofthe

MOUs,andStateFundandDPAwillagreetowaivecertainofthestepsthatotherwisewouldbe

requiredinordertoallowforamoreexpeditiousresolution.CASEhasagreedtoinitiallystay

Accordingly,thepartiesagreetothefollowing:

ThelawsuitfiledbyCASEinthiscaseisherebyandimmediatelystayedforall

purposes,andnofurtheractionbyStateFundorDPA.includingresponsivepleadingsormotion

tointervene,isrequired.

2.CASEwillnotinitiateanewlawsuitassertingthesameorsimilarclaimsinanother

jurisdiction.

3.CASEwillproceedwiththismatterthroughthegrievanceandarbitrationprovisions

noagreementcanbereachedbetweentheparties,thepartieswillfollowtheportionofsection7.l1BoftheMOUsthatspecifiesthemethodofselectionofanarbitratorintheeventnoagreementisreachedandwilldosoasquicklyasispracticable.7.

arbitrationhearingwillbesetnosoonerthan60daysafterselectionofthearbitrator.
