April 11, 2011 Dear Colleagues and Guests: Welcome to North Carolina for the 2011 NAAG Presidential Initiative Summit. Americas Financial Recovery: Protecting Consumers as We Rebuild, has been the year-long theme of the Presidential Initiative which has already produced ideas about how we can best protect consumers while we rebuild our countrys nancial structure. This Summit boasts an array of speakers who play a vital role in our economy. While in Charlotte, Attorneys General will meet with each other and invited guests to discuss solutions for a range of common nancial issues such as consumer scams, relationships with the newly created United States Bureau of Consumer Financial Protection, data sharing among state and federal agencies and emerging consumer protection issues. Charlotte is the second largest banking center in the country and has become a major force in our countrys economy. Its a great place to visit with arts, theatre, attractions, historic neighborhoods and sports. Most of all, you will be impressed with the people who live here. I hope you enjoy our social events at the NASCAR Hall of Fame and the Duke Mansion and feel free to stay and explore Charlotte. Thank you for your participation in this important and timely effort. The New World of Enforcement Post Dodd-Frank


The Act preserves the crucial role that state Attorneys General have in protecting consumers from nancial fraud and abuse not only by preserving state laws that are more stringent, but also by expanding the authority of Attorneys General to enforce federal laws and regulations. This discussion will focus on issues to consider regarding dual state-federal jurisdiction as well as best practices with respect to coordinated enforcement between state and federal agencies.

Preempted or NotReshaping of Federal and State Powers under Dodd-Frank


The Acts codication of Cuomo and Barnett signals Congresss favor of state law enforcement and its intention to allow more regulation of national banks by the states. It permits federal preemption only of inconsistent state statutes and thereby allows states to enact and enforce tougher banking standards. The creation of a protective oor rather than a ceiling at the federal level has the potential to signicantly change the authority of state Attorneys General in protecting consumers. What effect do these developments have on enforcement authorities of Attorneys General?

The Power of Data Sharing and Usage


In creating the Consumer Financial Protection Bureau, the Act contemplates an unprecedented amount of data sharing among federal agencies and between federal and state agencies. Beyond the mechanics of how information sharing systems should and can be implemented is the question of how this immense amount of data can best be utilized. This discussion will focus on how regulators can best use data not only to enforce the law, but also to educate consumers and prevent harm from occurring in the rst place.
