NOTIFICATION OF DECISION ON AN APPLICATION TO CARRY OUT WORKS ON PROTECTED TREES

refuses
 
consent
for the following works as shown in this application;
To remove seventeen Poplar trees at Barrow Close adjacent Coppice Road.For the following reasons;
The trees are healthy specimens that contribute significantly to the landscape of thearea. Their removal to allow more light into the flats cannot be justified as theamenity provided by the trees outweighs this reason given for their removal.
Problems with the gutters can be resolved with some remedial pruning without theneed to remove the trees.
No engineering solution has been explored to improve the TV reception to the flats.Walsall Metropolitan Borough Council, as a Local Planning Authority, hereby
grants
 consent for the following works;
To remove any branches from Poplar trees ‘T1’ through to ‘T11’ that areencroaching over the roof or towards the flats only back to a suitable pruning pointto give a clearance of approximately 2.0m.
 
Subject to the following conditions;1. All tree surgery shall be carried out by a contractor approved by the Head ofRegeneration, Delivery and Development, or a person who is appropriately insuredand competent in such operations.
Reason: 
To ensure a satisfactory standard of work.2. All tree surgery work shall be completed in accordance with British Standard B.S.3998:2010.
Reason: 
To protect the health and appearance of the tree(s) in the interest ofmaintaining the amenity of the area.

3. This permission expires 2 years from the date of the decision and any works notundertaken by the date of expiry shall be the subject of a further application.
Reason: 
In order to give the Local Planning Authority an opportunity ofreassessing the condition of the tree in the event of works not being carried out.
 
Note to Applicant;1. All 17 species of bat found in Britain are fully protected under the Wildlife andCountryside Act 1981 (as amended by National and European legislation). Theapplicant should inspect the trees for the presence of bat activity. If bats arediscovered during inspection or subsequent work, all work must cease immediatelyand Natural England must be informed. They can be contacted on 0845 600 3078.
 
2. All wild birds, their nests and eggs are protected under the Wildlife and CountrysideAct 1981. It is an offence to damage or destroy a nest of any wild bird. Birds aregenerally nesting between March and July, although exceptions to this do occur.
 
3. You may remove deadwood under Section 198(6a) of the Town and CountryPlanning Act 1990 as this operation is exempt from the need to obtain formalplanning permission.
