Facts Showing the Existence and Nature of the Emergency
The district court on October 12, 2010, permanently enjoined on aworldwide basis the government from enforcing 10 U.S.C. § 654,commonly referred to as the “Don’t Ask, Don’t Tell” statute, and its

implementing regulations. The government sought an emergency staypending appeal of that injunction. This Court granted the governmenta temporary administrative stay to permit the Court sufficient time toconsider the government’s emergency stay motion. Then on November1, 2010, the Court granted the government a stay pending appeal,concluding that “the lack of an orderly transition in policy will produceimmediate harm and precipitous injury,” and that “the public interestin ensuring orderly change of this magnitude in the military . . .strongly militates in favor of a stay.” ER 302-303. The Supreme Courtdenied plaintiff’s application to vacate this Court’s stay.Congress in December 2010 enacted the Don’t Ask, Don’t TellRepeal Act of 2010, establishing an orderly process for repealing § 654.Congress provided that repeal of § 654 is to be effective 60 days afterthe President, the Secretary of Defense, and the Chairman of the JointChiefs of Staff certify that “the Department of Defense has preparedthe necessary policies and regulations” for repeal, and that repeal “isconsistent with the standards of military readiness, militaryeffectiveness, unit cohesion, and recruiting and retention of the ArmedForces.” Pub. L. No. 111-321, § 2(b)(2)(B), (C), 124 Stat. at 3516 (2010).
