The grounds upon this challenge and dispute are herein-detailed 1) The onus of proof rest with the

accusing party 2) There is no facts or evidence that prove, by way of a sworn affidavit and supporting documentation , or substantiates the claim that the Speed Measuring Device, that has been used to allegedly record the speed of the automobile on 23/10/2009, conforms to the National Measurement Act 1960 (Cth) in respect of its use for making measurements for any legal and monetary purpose or similar; 3) There is no facts or evidence that prove that the speed measuring device is a lawful, legal and certified measurement device to measure and record in accordance with Commonwealth legal units of measurement, as defined by the National Measurement Act 1960 (Cth). The only lawful way of doing this is to provide the specific NSC (National Standards Commission) number that has been allocated to this device and by providing a certificate that has been issued for this device under Regulation 13 of said Act 4) There is no facts or evidence that the Queensland Police Service and/or Queensland Transport have the authority to overthrow or override Federal/Commonwealth Law, nor facts or evidence of an exemption or licence to breach Federal/Commonwealth Law; 5) There is no facts or evidence that prove that the device was used in accordance with the training manual and operators manual that relates to this device and that the operator adhered to all the guidelines and policies for the use of this device in the State of Queensland, issued by the QUEENSLAND POLICE SERVICE; 6) There is no facts or evidence detailing the style, type and all other details that may be used to identify the speed measurement device as herein-referenced both specific and generally so that further appropriate information may be sought once the device details are revealed; 7) There are no facts or evidence of the last 12 months of service and maintenance records of the speed measurement device herein-referenced; 8) There are no facts or evidence that provide the set-up and deployment records of the speed measurement device herein-referenced for the day of 23/10/2009; 9) There are no facts or evidence that of current calibration certificate(s) of the speed measurement device herein-referenced; 10) There are no facts or evidence of any speed measurement calibration testing and maintenance records for the speed measurement device herein-referenced; 11) There is no facts or evidence circuitry calibration testing and maintenance records for the speed measurement device herein-referenced;

12) There are no facts or evidence that prove the correct use, operation and deployment in accordance with the operators manual for the speed measurement device herein-referenced;

13) There are no facts or evidence that prove that the style of speed measurement device in this instance or any type of speed measurement device has never made a mistaken or erroneous reading of speed. 14) There are no facts or evidence that prove that the operator of the speed measurement device made no errors in the set-up, deployment and operation of the speed measurement device herein-referenced; 15) There is no facts or evidence that prove that the photographic evidence has not been manipulated or modified; 16) There are no facts or evidence that prove that the algorithm for the speed-measuring device is totally secure, and not available from sources other than the Queensland Police Service and/or Queensland Transport
