isfurtherunderstoodthatanyforfeiture
of
theSpecificPropertyshallnotbetreated
as
satisfaction
of
anyfine,restitution,cost
of
imprisonment,oranyotherpenaltytheCourtmayimposeuponhiminadditiontoforfeiture.However,thisOfficeagreestorequestthattheDepartment
of
JusticeinvokeitsRestorationPolicyandcauseanyfundsandotherpropertyforfeitedinthiscasetobeappliedtoanyrestitutionorderimposedinthiscase.Inaddition,thedefendantherebyagreestowaivehisrighttocontesttheforfeitureunderFederalRule
of
CriminalProcedure32.2(a)onthegroundthataninformationorindictmentdidnotcontainnoticethattheGovernmentisseekingforfeiture.Inconsideration
of
thedefendant'spleatotheaboveoffense,thedefendantwillnotbefurtherprosecutedcriminallybythisOffice(exceptforcriminaltaxviolations
as
towhichthisOfficecannot,anddoesnot,makeanyagreement)fortheconductchargedinCountsOneandTwo
of
theInformation.Inaddition,atthetime
of
sentencing,theGovernmentwillmovetodismissanyopenCount(s)againstthedefendant.Thedefendantagreesthat
