OnMay13,2009throughMay16,2009,theCourtconductedahearingonMotionstoSuppressfiledinSchleicherCountyCauseNos.991,992,993,994,995,998,999,1000,1001,1002,1003,1004,1013,1014,1015,1016,1018,1019,and1020.ThehearingsontheMotionstoSuppressinthesecaseswereconsolidatedbytheCourt,upontheagreementofthepartiesintheabove-listedcases.TheDefendantshadfiledseveraldifferentMotionstoSuppressinthesemattersandtheCourtconsideredalloftheseMotionsatthishearing.Thehearingconsistednotonlyofargumentofcounsel,butalsolivetestimonyfromelevenwitnessesandtheadmissionofaffidavitsanddocumentaryevidence.TheCourtentersthefollowingfindingsoffactandconclusionsoflawwithrespecttoallMotionstoSuppress.
FINDINGSOFFACT
1.TheMotionstoSuppressandthehearingconcernedtwosearchwarrants,whichwereissuedunderCauseNos.M-08-001-SandM-08-002-S.2.TheCourtfindsthattheSearchandArrestWarrantCauseNo.M-08-001-SwasissuedafteraprobablecauseaffidavitforsearchandarrestwarranthadbeenpresentedbyTexasRangerLeslieBrooksLong(hereinafterreferredtoasRangerLong)totheissuingmagistrate.3.TheCourtfindsthatWarrantM-08-001-SwasissuedonApril3,2008,at5:50p.m.EntryontotheYFZRanchpremiseswasmadepursuanttothewarrantatapproximately9:00p.m.onApril3,2008.4.TheCourtfindsthattheSearchWarrantCauseNo.M-08-002-SwasissuedafteraprobablecauseaffidavitforasearchwarranthadbeenpresentedbyRangerLongtothe
issuingmagistrate.5.TheCourtfindsthattheSearchWarrantM-08-002-SwasissuedonApril6,2008at10:12p.m.PeaceofficersbegantoexecutethewarrantattheYFZRanchfollowingitsissuance.6.TheCourtfindsthattheDepartmentofFamilyandProtectiveServices(hereinafterreferredtoasthe"Department"oras"DFPS")onApril3,2008,filedaPetitionForOrdersinAidofInvestigationofaReportofChildAbuseorNeglect,andthatthesubjectsofsaidpetitionwereSaraJessopakaSarahBarlowandanunnamedbabygirl.7.TheCourtfindsthatadistrictjudgesignedanOrderforInvestigationofChildAbusedatedApril3,2008.8.TheCourtfindsthattheDepartmentonApril6,2008,filedasecondPetitionForOrdersinAidofInvestigationofaReportofChildAbuseorNeglect,andthatthesubjectsofsaidpetitionwerethechildrenlocatedattheYFZRanch.9.TheCourtfindsthatanOrderforInvestigationofChildAbusedatedApril6,2008,wassignedbyadistrictjudge.10.ThatDefendants'JointConsolidatedMotiontoSuppressfiledonApril14,2009,containsanattachedExhibit15whichconsistofthePetitionforOrderinAidofInvestigationofaReportofChildAbuseorNeglectthatwasfiledwiththeCourtonApril3,2008,howeveraffidavitinsupportofthatPetitionisnottheaffidavitthatwasattachedtoDefendants'Exhibit15.TheCourthasincludedasAttachment"A"atrueandcorrectcopyoftheApril3,2008,Petition,thecorrectcopyofthesupportingaffidavit,andacopyoftheOrdersignedbytheCourt.11.TheCourthasincludedasAttachment"B"tothisFindingofFactatrueandcorrectcopyofthePetitionforOrderinAidofInvestigationofaReportofChildAbuseorNeglectthatwasfiledwiththeCourtonApril6,2008,thecorrectcopyofthesupportingaffidavit,andacopyoftheOrdersignedbytheCourt.12.TheDefendantsdidnottestifyatthehearingonthemotionstosuppress,butinsteadchosetoproduceaffidavitstosupporttheirclaimsofstanding.TheseaffidavitswereconsideredbytheCourt,alongwithotherevidencerelatedtostanding,pursuanttoTex.CodeCrim.Proc.art.28.01.13.TheCourtfindsthatthepropertythatwasthesubjectofthetwosearchwarrantsisa1691acreranchandimprovementslocatedthereon.14.TheCourtfindsthatsaidpropertyatthetimeofthesearcheswasownedbyYFZLand,LLC.TheCourtfindsthattheYFZLand,LLCislistedasaTexaslimitedliabilitycompany,whoselistedpresidentisDavidS.Allred.15.TheCourtfindsthatlocatedontheYFZRanchpropertytherearenumerousstructures,includinganumberofstructuresthatcouldbeusedforresidentialpurposes,severalthatcouldbeusedbyresidentsinthepracticeoftheirreligion,somestructuresthatrelateto
