laworfactincommonwiththemainactionandgrantingthemotionwillnotundulydelayorprejudicetheadjudicationoftheoriginalparties.Asgroundsforthismotion,andasmorefullyexplainedinthememoranduminsupportofthismotionfiledherewith,theProposedDefendant-IntervenorsshowtheCourtthefollowing:1.ThePlaintiffSTATEOFTEXASbroughtthisactiontoobtainpreclearancepursuanttoSection5oftheVotingRightsActforitscongressional,stateboardofeducation,andstate-legislativeredistrictingplans.2.ProposedDefendant-IntervenorsseektointerveneasamatterofrightpursuanttoFed.R.Civ.P.Rule24(a)(2),or,inthealternative,tointervenepermissivelypursuanttoFed.R.Civ.P.24(b).3.TheComplaintwasfiledonJuly19,2011.Thismotionisbeingfiledonlytwo(2)daysafterthecomplaintwasfiledandbeforeDefendanthasfiledananswer.ProposedDefendant-Intervenorscancomplywithanydiscoverydeadlines(oranyotherdeadlinestobesetinthisaction)withoutcausinganydelayinthelitigation.Thus,interventionistimelyandwillnotdelayorprejudicetheadjudicationoftherightsoftheoriginalparties.TheProposedDefendant-Intervenors4.ProposedDefendant-IntervenorSenatorWENDYDAVISresidesat2737CalderCourtinFortWorth,TX76107-3077.SenatorDAVISseekstointerveneindividuallyasavoterwhoresidesinFt.Worth,Texasandasanofficeholderinherofficialcapacityasstatesenatorfromthe10thDistrict,currentlyaneffectiveminorityopportunitydistrictthatwillbedestroyediftheStateofTexasissuccessfulinobtainingpreclearanceofthestatesenateplan.ProposedDefendant-IntervenorDAVIS,whoisAnglo,residesincurrentSenateDistrict10("SD10")andundertheState'sproposedsenateplanwouldresideinSD10.UndertheState'sproposedsenate2
 
plan,SD10isconvertedfromadistrictinwhichminorityvoterscurrentlyhaveanopportunitytoparticipateeffectivelyinthepoliticalprocessandhaveelectedacandidateoftheirchoicetoadistrictthatisAnglo-votercontrolledandinwhichminorityvoterswillnolongerhaveameaningfulopportunitytoparticipateinthepoliticalprocessorelecttheirpreferredcandidatetooffice.5.ProposedDefendant-IntervenorRepresentativeMARCVEASEYisanAfrican-Americanvoterwhoresidesat8224LongfellowLaneinFortWorth,TX76120-5067.Rep.VEASEYseekstointerveneindividuallyasavoterandinhisofficialcapacityasamemberoftheTexasStateHouseofRepresentativesforthe95thDistrict.ProposedIntervenorVEASEYisaresidentofCongressionalDistrict26andSenateDistrict10undertheexistingplans,andwillbearesidentofCongressionalDistrict12andSenateDistrict10undertheproposedplansatissuehere.RepresentativeVEASEY,aswellasotherminorityvotersinhisdistrict,willsufferaretrogressionofminorityvotingstrengthwithrespecttotheireffectiveuseoftheelectoralfranchiseasaresultofthedismantlinganddestructionofstatesenateDistrict10undertheState'sproposedstatesenateplan.6.ProposedDefendant-IntervenorJOHNJENKINSisanAfrican-Americanvoterwhoresidesat6723Smallwood,Arlington,Texas76001inTarrantCounty,Texas.ProposedIntervenorJENKINSisaresidentofCongressionalDistrict6andSenateDistrict10undertheexistingplans,andwillbearesidentofCongressionalDistrict33andSenateDistrict9undertheproposedplansatissuehere.ProposedDefendant-IntervenorJENKINSseekstointervenetoprotecthisvotingrightsandthoseofotherminorityvotersintheDallas-Ft.WorthregionwhowillsufferaretrogressionoftheirvotingstrengthiftheState'sproposedcongressionalmapandstatesenatemaparepreclearedundertheVotingRightsAct.3
