The following Ordinance by the Governor of the North-West Frontier Province is hereby published for general information:THE NORTH-WEST FRONTIER PROVINCE CIVIL SERVANTS (AMENDMENT) ORDINANCE, 2000. N.W.F.P. ORDINANCE NO. VIII OF 2000. AN ORDINANCE further to amend the North-West Frontier Province Civil Servants Act, 1973. WHEREAS it is expedient further to amend the North-West Frontier Province Civil Servants Act, 1973 (N.-W.F.P. Act No. XVIII of 1973), for the purpose hereinafter appearing; AND WHEREAS the Provincial Assembly stands suspended in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999; AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action; NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province, on the instructions of the Chief Executive of Pakistan, is pleased to make and promulgate the following Ordinance:1. Short title and commencement (1) This Ordinance may be called the North-West Frontier Province Civil Servants (Amendment) Ordinance, 2000. (2) It shall come into force at once. 2. Substitution of section 13 ofN.-W.F.P. Act No. XVIII of 1973. In the North-West Frontier Province Civil Servants Act, 1973 (N.-W.F.P. Act No. XVIII of 1973), for section 13 the following shall be substituted, namely:"13. Retirement from service. (1) A Civil Servant shall retire from service1. on such date after he has completed twenty-five years of service qualifying for pension or other retirement benefits as the competent authority may, in public interest, direct; or 2. where no direction is given under clause (a), on the completion of sixtieth year of his age. (2) No direction under clause (a) of sub-section (l) shall be made until the civil servant has been informed in writing of the grounds on which it is proposed to make the direction, and has been given a reasonable opportunity of showing cause against the said direction. Explanation.In this section, the expression "competent authority" means the appointing authority prescribed in rule 4 of the North-West Frontier Province Civil Servants (Appointment, Promotion and Transfer) Rules, 1989.". ------------------------------------------
