§5-11-1.
Shorttitle.
Thisarticleshallbeknownandmaybecitedandreferredtoas"TheWestVirginiaHumanRightsAct."§5-11-2.
Declaration
ofpolicy.
It
isthepublicpolicyofthestateofWestVirginiatoprovideallofitscitizensequalopportunityforemployment,equalaccesstoplacesofpublicaccommodations,andequalopportunityinthesale,purchase,lease,rentalandfinancingofhousingaccommodationsorrealproperty.Equalopportunityintheareasofemploymentandpublicaccommodationsisherebydeclaredtobeahumanrightorcivilrightofallpersonswithoutregardtorace,religion,color,nationalorigin,ancestry,sex,age,blindnessordisability.Equalopportunityinhousingaccommodationsorrealpropertyisherebydeclaredtobeahumanrightorcivilrightofallpersonswithoutregardtorace,religion,color,nationalorigin,ancestry,sex,blindness,disabilityorfamilialstatus.Thedenialoftheserightstoproperlyqualifiedpersonsbyreasonofrace,religion,color,nationalorigin,ancestry,sex,age,blindness,disabilityorfamilialstatusiscontrarytotheprinciplesoffreedomandequalityofopportunityandisdestructivetoafreeanddemocraticsociety.§5-11-3.
Definitions.
Whenusedinthisarticle:(a)Theterm"person"meansoneormoreindividuals,partnerships,associations,organizations,corporations,labororganizations,cooperatives,legalrepresentatives,trustees,trusteesinbankruptcy,receiversandotherorganizedgroupsofpersons;(b)Theterm"commission"meanstheWestVirginiahumanrightscommission;(c)Theterm"director"meanstheexecutivedirectorofthecommission;(d)Theterm"employer"meansthestate,oranypoliticalsubdivisionthereof,andanypersonemployingtwelveormorepersonswithinthestatefortwentyormorecalendarweeksinthecalendaryearinwhichtheactofdiscriminationallegedlytookplaceortheprecedingcalendaryear:Provided,Thatsuchtermsshallnotbetaken,understoodorconstruedtoincludeaprivateclub;(e)Theterm"employee"shallnotincludeanyindividualemployedbyhisorherparents,spouseorchild;

Theterm"labororganization"includesanyorganizationwhichexistsforthepurpose,inwholeorinpart,ofcollectivebargainingorofdealingwithemployersconcerninggrievances,termsorconditionsofemploymentorforothermutualaidorprotectioninrelationtoemployment;(g)Theterm"employmentagency"includesanypersonundertaking,withorwithoutcompensation,to
Page2of14procure,recruit,referorplaceemployees.Anewspaperengagedintheactivityofadvertisinginthenormalcourseofitsbusinessshallnotbedeemedtobeanemploymentagency;(h)Theterm"discriminate"or"discrimination"meanstoexcludefrom,orfailorrefusetoextendto,apersonequalopportunitiesbecauseofrace,religion,color,nationalorigin,ancestry,sex,age,blindness,disabilityorfamilialstatusandincludestoseparateorsegregate;(i)Theterm"unlawfuldiscriminatorypractices"includesonlythosepracticesspecifiedinsectionnineofthisarticle;(j)Theterm"placeofpublicaccommodations"meansanyestablishmentorperson,asdefinedherein,includingthestate,oranypoliticalorcivilsubdivisionthereof,whichoffersitsservices,goods,facilitiesoraccommodationstothegeneralpublic,butshallnotincludeanyaccommodationswhichareintheirnatureprivate.Totheextentthatanypenitentiary,correctionalfacility,detentioncenter,regionaljailorcountyjailisaplaceofpublicaccommodation,therights,remediesandrequirementsprovidedbythisarticleforanyviolationofsubdivision(6),sectionnineofthisarticleshallnotapplytoanypersonotherthan:(1)Anypersonemployedatapenitentiary,correctionalfacility,detentioncenter,regionaljailorcountyjail;(2)anypersonemployedbyalaw-enforcementagency;or(3)anypersonvisitinganysuchemployeeorvisitinganypersondetainedincustodyatsuchfacility;(k)Theterm"age"meanstheageoffortyorabove;(1)Forthepurposeofthisarticle,apersonshallbeconsideredtobeblindonlyifhiscentralvisualacuitydoesnotexceedtwenty/twohundredinthebettereyewithcorrectinglenses,orifhisvisualacuityisgreaterthantwenty/twohundredbutisoccasionedbyalimitationinthefieldsofvisionsuchthatthewidestdiameterofthevisualfieldsubtendsananglenogreaterthantwentydegrees;and(m)Theterm"disability"means:(1)Amentalorphysicalimpairmentwhichsubstantiallylimitsoneormoreofsuchperson'smajorlifeactivities.Theterm"majorlifeactivities"includesfunctionssuchascaringforone'sself,performingmanualtasks,walking,seeing,hearing,speaking,breathing,learningandworking;(2)Arecordofsuchimpairment;or(3)Beingregardedashavingsuchanimpairment.Forthepurposesofthisarticle,thistermdoesnotincludepersonswhosecurrentuseoforaddictiontoalcoholordrugspreventssuchpersonsfromperformingthedutiesofthejobinquestionorwhoseemployment,byreasonofsuchcurrentalcoholordrugabuse,wouldconstituteadirectthreattopropertyorthesafetyofothers.
§5-11-4.Powersandobjectives.
Thecommissionshallhavethepowerandauthorityandshallperformthefunctionsandservicesasinthisarticleprescribedandasotherwiseprovidedbylaw.Thecommissionshallencourageandendeavortobringaboutmutualunderstandingandrespectamongallracial,religiousandethnicgroupswithinthestateandshallstrivetoeliminatealldiscriminationinemploymentandplacesofpublicaccommodationsbyvirtueofrace,religion,color,nationalorigin,ancestry,sex,age,blindnessorhandicapandshallstrivetoeliminatealldiscriminationinthesale,purchase,lease,rentalorfinancingofhousingandotherrealpropertybyvirtueofrace,religion,color,nationalorigin,ancestry,sex,

§5-11-5.Composition;appointment,termsandoathofmembers;compensationandexpenses.
Thecommissionshallbecomposedofninemembers,allresidentsandcitizensofthestateofWestVirginiaandbroadlyrepresentativeoftheseveralracial,religiousandethnicgroupsresidingwithinthestate,tobeappointedbythegovernor,byandwiththeadviceandconsentoftheSenate.Notmorethanfivemembersofthecommissionshallbemembersofthesamepoliticalpartyandatleastonemember,butnotmorethanthreemembers,shallbefromanyonecongressionaldistrict.MembersofthecommissionshallbeappointedfortermsofthreeyearscommencingonthefirstdayofJulyoftheyearoftheirappointments,exceptthattheninemembersfirstappointedhereundershallbeappointedfortermsoffromonetothreeyears,respectively,sothatthetermsofthreemembersofthecommissionwillexpireonthethirtiethdayofJuneofeachsucceedingyearthereafter.Upontheexpirationoftheinitialterms,allsubsequentappointmentsshallbefortermsofthreeyearseach,exceptthatappointmentstofillvacanciesshallbefortheunexpiredtermthereof.Membersshallbeeligibleforreappointment.Beforeassumingandperforminganydutiesasamemberofthecommission,eachcommissionmembershalltakeandsubscribetotheofficialoathprescribedbysection5,articleIVoftheconstitutionofWestVirginia,whichexecutedoathshallbefiledintheofficeofthesecretaryofstate.Themembersofthecommissionshallnotreceiveasalary,buteachappointedmembershallbepaidfiftydollarsperdiemforactualtimespentintheperformanceofdutiesunderthisarticleandshallbereimbursedforactualandnecessaryexpensesincidenttotheperformanceoftheirduties,uponpresentationofanitemizedandswornstatementthereof.TheforegoingperdiemandreimbursementforactualandnecessaryexpensesshallbepaidfromappropriationsmadebytheLegislaturetothecommission.
§5-11-6.Commissionorganizationandpersonnel;executivedirector;offices;meetings;quorum;expensesofpersonnel.
AssoonaspracticalafterthefirstdayofJulyofeachyear,thegovernorshallcallameetingofthecommissiontobeconvenedatthestatecapitol.Thecommissionshallatsuchmeetingorganizebyelectingoneofitsmembersaschairpersonofthecommissionandoneasvicechairpersonthereofforatermofoneyearoruntiltheirsuccessorsareelectedandqualified.Atsuchmeetingthecommissionshallalsoelectfromitsmembershipsuchotherofficersasmaybefoundnecessaryandproperforitseffectiveorganization.Thegovernorshall,byandwiththeadviceandconsentoftheSenate,appointanexecutivedirectortoserveathisorherwillandpleasure.Theexecutivedirectorshallserveassecretaryofthecommission.Theexecutivedirectorshallhaveacollegedegree.Heorsheshallbeselectedwithparticularreferencetohisorhertraining,experienceandqualificationsforthepositionandshallbepaidanannualsalary,payableinmonthlyinstallments,fromanyappropriationsmadetherefor.Thecommission,uponrecommendationoftheexecutivedirectorandinaccordancewiththerequirementsofthecivilservicelaw,mayemploysuchpersonnelasmaybenecessaryfortheeffectiveandorderlyperformanceofthefunctionsandservicesofthecommission.Thecommissionshallemployanadministrativelawjudgewhoshallbeanattorney,dulylicensedtopracticelawinthestateofWestVirginia,fortheconductofthepublichearingsauthorizedinsubdivision(3),subsection(d),sectioneightofthisarticle.Thecommissionshallequipandmaintainitsofficesatthestatecapitolandshallholditsannualorganizationalmeetingthere.Thecommissionmayholdothermeetingsduringtheyearatsuchtimes
