A form entitled “Non-Mo-torized Trail Agreement” thatat rst glance looks as thoughit came from the county, butdidn’t, has been circulatingand found its way to the boardof county commissioners whosay it is not a form draed orapproved of by the county board.Commissioners each have acopy of the form and dis-cussed it at July 20 and July 27meetings.A citizen brought the formto the July 27 meeting andasked if it was from the county and if it was legal.“No,” was the answer fromboard chairman Joel Evans. He explained that the board isaware of the document andhas been trying to ndout who draed it.e mystery form has thewords “County of Charlevoix”and the address and phonenumber for the county build-ing at the top of the page. Itasks residents to agree to theconstruction of the non-mo-torized trail on the road right-of-way. e recreational trail isproposed to run along theBoyne City-Charlevoix Road

As cities in Charlevoixcounty and elsewhere in thestate attempt to come intocompliance with the med-ical marijuana law by zon-ing to allow dispensaries, legislators are introducingbills to clarify and reformthe 2008 Act.Six bills have been intro-duced thus far in the stateHouse. e bills have beenreferred to the House Judi-ciary Committee. One of the bills, H.B. 4834, wouldrequire patients to providecurrent color photos asidentication to be usedwith the patient registry card. State Rep. Greg Mac-Master is a co-sponsor onthis bill. Other bills wouldprohibit medical marijuanafrom being used in barsand clubs, prohibit patientsfrom growing medical mar-ijuana plants within 500-feet of a church, school orday care center, would clar-ify a bona de physician-patient relationship andwould prohibit use of med-ical marijuana in a schoolbus, on the grounds of any preschool, primary or sec-ondary school, in any cor-rectional facility or in any public place. Bills have alsobeen introduced in the stateSenate.A June 28 Opinion by At-torney General BillSchuette states that theMichigan Medical Mari- juana Act does not providefor the operation of cooper-atives. Whether that ex-tends to dispensariesremains to be seen.e Michigan MedicalMarijuana Act does statethat either the patient orthe patient’s caregiver, but

from Boyne City to U.S. 31 inCharlevoix Township.Aer lengthy discussion aboutthe origin of the form, county board of commissioners’ chairman,Joel Evans, checked with counsel.“is form is not effective, is thatright? “Attorney Shaynee Fanara said itwas not a valid document.“en it doesn’t matter whodraed it,” Evans said.Commissioner Chris Chris-tensen said at the July 20 meetingthat he could understand why there is confusion because of theappearance of the document, butnoted it was missing county au-thentication.“It’s not on county letterhead,”Christensen said. “We want toreach out to the people who signedit and let them know it’s not ourform.”Bay Township resident RogerConaway said the form is mislead-ing. He is concerned about theroute of the proposed trail and thatit would infringe on property rights. He requested that thecounty stake the route of the non-motorized trail so people know ex-actly where it would run.
