NO.2911(FirstReprint)TotheGeneralAssembly:PursuanttoArticleV,SectionI,Paragraph14oftheNewJerseyConstitution,IamreturningAssemblyBillNo.2911(FirstReprint)withmyrecommendationsforreconsideration.Underthislegislation,amunicipalfreepubliclibrarywouldbeobligatedtotransfertothemunicipalityanyundesignatedsurplusfundsinexcessof20%ofthatlibrary'sauditedoperatingexpendituresforapriorbudgetyear.Undercurrentlaw,amunicipalfreelibraryisauthorizedtoreturn-onavoluntarybasis-surplusfundsinexcessof125%ofitsauditedoperatingexpendituresforapriorbudgetyear,butonlyafterthemunicipalfreelibraryhasbeeninexistenceforeightbudgetyears.Moreover,undercurrentlaw,theselibrariescannottransfersurplusfundsunlessthelibraryisdeterminedtobeincompliancewithallapplicablerulesandregulationsundertheStateLibraryAidLaw,whichincludesstandardstoensurethatlibrariesmaintaincertainstaffing,operational,andresourcelevels.Icommendthesponsors'recognitionthatsharedsacrifice

mustberealizedatalllevelsinthistimeofunprecedentedeconomiccrisis.Ialsoagreewiththesponsorsthatanincreasedpercentageoflibrarysurplusesshouldbemadeavailabletomunicipalitiesforpropertytaxrelief.Inthiscurrentfiscalandeconomicclimate,nogovernmententityshouldbesittingonanexcesssurplus-theproverbialrainydayhasarrived.Iamconcerned,however,thattheapproachembracedbythisbillfailstopreservethecomponentofcurrentlawthatensuresmaintenanceofqualitystandards.Theseminimumstandards

ensurethatmunicipalitiesdonotneglecttheirlibrariesandallowthem.tofallintodisrepairordisuse.Ibelievethatourpubliclibrariesareaneducational,informational,andrecreationalresourceforallcitizensthatmustbesafeguardedandpreserved.Assuch,

amreturningthislegislationwiththerecommendationthattheLegislaturerestoretheprotectionscontainedunderthecurrentlaw.Suchrestorationwillcontinuetoallowmunicipalitiestoreclaimexcesssurplus,butonlyafterithasbeenverifiedthatthelibraryisprovidingqualityservicesandaccesstoitscitizens.Myrecommendationsalsoareintendedtoensurethatanyreturnedfundswillbeused"solelyandexclusivelybythemunicipalityforthepurposesofreducingtheamountthemunicipalityisrequiredtoraisebylocalpropertytaxlevy,"asrequiredunderexistinglaw,N.J.S.A.40A:4-25.1.Thisbillinitscurrentformfailstoclearlyaddressthisimportantissue,bypurportingtoallowthefundstobeusedforotherpurposes,whichmayormaynotincludepropertytaxrelief.IbelievethatthereturnofthesefundsmustdirectlyaccruetothebenefitofthetaxpayersofNewJersey.Accordingly,IherewithreturnAssemblyBillNo.2911(FirstReprint)andrecommendthatitbeamendedasfollows:Page2,Section1,Lines23-25:Delete"undesignatedgeneralfundbalanceinexcessof20percentoftheauditedoperatingexpendituresfortheprecedingbudgetyear"andinsert"amountthatexceedsthesumoftheamountoftheauditedoperatingexpendituresofthelibraryforthemostrecentavailableyear,plusanadditional20%ofthoseoperatingexpenditures,excluding
