countscontainedintheInformation.AftertheDefendant'spleawasaccepted,Mr.BaezaskedtheCourttowithholdadjudicationofguiltonallcounts,givePage1of13

hercreditfortimeserved,and"duetostatutoryrequirementsgiveherashortprobationaryperiodofapproximatelyoneyearfollowing,andanycreditfortimeservedthatthecourtwouldgive."AssistantStateAttorneyFrankGeorgerecommendedtotheCourtthattheDefendant
shouldbeadjudicatedguiltyonall13countsandbesentencedtoastraightincarcerativesentence
withnoprobationtofollow.
Mr.
GeorgesaidthefollowingconcerningplacingtheDefendantonprobation:There'snoearthlypointinputtingMissAnthonyonprobation,which,ineffect,iscommunitysupervision.Sheisbeingsupervised24hoursaday.Sheisinjail.Andshewillbesofortheveryforeseeablefuture,andmaybefortherestofherlife.TheCourtadjudgedtheDefendantguiltyofcounts1,2,3,6,9,and12andsentencedhertotimeservedof412days.Noprobationwasorderedonthosecounts.TheCourtwithheldadjudicationofguiltastocounts4,5,7,8,10,11,and13andsentencedhertooneyearsupervisedprobation.TheDefendantwasalsosentencedonthosecountsto412daysinjailwithcreditfor412days.Concerningwhentheprobationarysentencewastobegin,JudgeStrickland,inhisoralpronouncement,stated:SowhatI'mgonnadoonthosecountsthatI'morderingprobationandgivingherwithholds--again,that'sCounts5,8,11--threeofthefourfraudulentpersonalIDcounts--there'sgonnabeawithhold,followed
byayearofsupervisedprobation,oncereleased--

iscleartheCourtstatedtheDefendant'sprobationwastostartonceshewasreleasedfromjail.OncetheDefendantreceivedasentenceoftimeservedof412daysoncounts1,2,3,6,9,and12,theonlyreasonthatkeptherincustodywashernobondstatusinaseparatePage2of13

anddistinctcase,CaseNumber4S-200S-CF-lS606-AOonthechargesofmurderinthefirstdegreeandotherchargescontainedintheIndictment.AftertheCourtannouncedthesentence,theState,throughMr.George,raisedtheissue
concerningtheDefendant'sprobationstartingatanindefinitetimeinthefuture.TheCourt
repliedbysayingthatitmayhavetotweakit,butitwasunsurehowtohandletheissueotherthanthewayitwasbeinghandled.JudgeStricklandspecificallyindicated:Imayhavetotweakit.I'vebeenthinkingaboutthis,andI'mnotsurehowelsetodoitIdon'tknowthatit'sthatindefinite,becausethisiscomingupanditwillnot--thetrialI'mspeakingofiscomingupwithintheperiodthatI'vegottoworkwith.Sinceit'swithinthefiveyearsthatI'vegottoworkwith,IthinkI'mokay.Tellmeifyouthink--Mr.George,goahead.Mr.GeorgethenstatedthatAssistantStateAttorneyJeffAshtonsuggestedthattheDefendant'sprobationcouldstartthat

Mr.
BaezalternativelysuggestedtheproblemcouldberesolvedbyallowingtheDefendanttobereleasedonbailinherotherpendingcase,thusfreeinghertostartherprobation.Inreplytobothsuggestions,JudgeStricklandsaid,"I'mwillingtoreconsiderandmodifythesentenceifthere'sabetterwayofdoingthis.Ithinkeverybody'sgoalisthesameand--Mr.Baez,anythingelsefromyouonthat,"towhichMr.Baezstatedno.Page
