Street,Northwest,Washington,DC,forthereportofanunconsciousperson.Onceonthescene,officerslocatedthedecedent,91-year-oldViolaDrath,unconsciousandlyingonthefloorofthebathroomlocatedonthesecondfloorofthehome,atwo-storyrowhouseownedbythedecedent.MembersoftheDCFireDepartmentrespondedtothesceneandfoundnosignsconsistentwithlife.Accordingly,theyleftthedecedent'sremainsonthescene.Thedecedentwasdressedinablackshirtandbeigeunderwear.Thedecedentwaspronounceddeadat12:22p.m.byMLIIPAMichelleMack,andherremainsweretransportedtotheOfficeoftheChiefMedicalExaminer("OCME")fortheDistrictofColumbiapendinganautopsy.Priortotransport,thedecedent'sremainswereinspectedbyanOCMEForensicInvestigatorwhophotographedthemand

reportedobservationstoDeputyMedicalExaminerCarolynRevercomb,whobasedonherexpertiseandthatreport,supplementedbyherownsubsequentobservationsatautopsy,estimatedthatthevictimhadmostlikelydiedwithintwelvehoursof11:20a.m.,thetimeofpreliminaryexaminationbytheForensicInvestigator.Laterthesameevening,tbeWashingtonPostreceivedanemailfromasenderidentifiedasAlbrechtMuthprovidinganobituaryastothedecedent.Thedecedent's47-year-oldhusband(hereinafterreferredtoas"thedefendant")wentbythatname.Intheemailedobituary,thedecedentwasreferredtoashavingdiedafter"sustainingaheadinjuryfromafall."OnSaturdayAugust13,21011,Dr.Revercombperformedanautopsyonthedecedent'sremains.Duringtheautopsy,Dr.Revercombnotedseveralinjuriestothedecedent'sbody,including,butnotlimitedto,bruisingandabrasionsoftheneck,bruisingtothescalp,fracturedanteriorneckcartilage,petichialhemorrhagesinbotheyes,fracturedribs,andatomrightthumbnail.Dr.Revercombconcludedthatthedecedent'sdeathwascausedbystrangulationandbluntforceinjuriesandruledthedecedent'sdeathaHOMICIDE.Laterthatsameday,detectivesinterviewedthedefendantafterhevoluntarilycametotheHomicideBranch.Theinterviewwasrecorded.Thecourseoftheinterviewissummarizedbelow,inpertinentpart.

Thedefendantreportedthathewaswiththedecedentupuntil4:00p.m.,onThursday,AugustII,20II,whenhelefttheresidencetomeetafriend.Thedefendantrefusedtoprovidethenameofthefriendwithwhomheclaimedtomeet.Thedefendantclaimedthathereturnedhomearound9:45p.m.thatnight.Afterreturninghome,thedefendantsaidthathedidnotseethedecedent,indicatingthatheenteredthroughthebasementdoorofthehouse.Thedefendantclaimedthathethengotsomethingtodrinkandwenttothesecondlevelofthehousetohisstudy.Thedefendantsaidthatthesecondlevelofthehouseconsistsoftwostudies,twofullbathrooms,andtheirbedroom.Thedefendant'sstudyoverlooksthe3200blockofQStreet,NW.Thedefendantsaidheenteredhisstudyandutilizedhiscomputertocheckhisemails.Thestudyislocateddirectlynexttothebathroomwherethedecedent'sbodywasfound.Aftercheckinghisemails,thedefendantclaimedthathewentbacktothebasementandwentforhiseveningwalkforapproximatelyonehour.Uponhisreturntothehouse,thedefendantclaimedthatheremainedinthebasementwhereheeventuallywenttosleep.Hesaidthathesleptonacouchinthebasementbecauseitwastoowarmupstairs.Accordingtothedefendant,thedecedentdidnotliketheairconditioneron,sohe

tosleepinginthebasement.ThedefendantreportedthatonFridayAugust12,2011,hewokeuparound4:00

andwalkedupstairstohisstudytocheckhisemail.Heclaimedthatatthattimehestillhadnocontactwiththedecedent.Aftercheckinghisemail,thedefendantsaidhereturnedtothebasement.Hethenclaimedthatatapproximately7:00a.m.,heleftthehouseandwentforhismorningwalk,returningtothehouseatapproximately7:50a.m.Accordingtothedefendant,afternothearingorseeingthedecedentduringthemorning,hewentupstairstocheckonher,foundherunconsciousonthebathroomfloor,andcalled911.Thedefendantsaidhedidnottouchthedecedentuponfindingheronthefloor.YouraffiantaskedthedefendantifheperformedCPRonthedecedent,andthedefendantsaidthattherewasnoneedfor
CPR.

DetectivesadvisedthedefendantthattheOCMEforensicpathologisthadruledthedecedent'sdeathahomicide.Thedefendantwantedtoknowthecauseofdeath.Detectivesexplainedtohimthattheycouldnotprovidehimwiththecauseofdeath.Thedefendantthenaskedforatimeofdeath.DetectivestoldhimthattheforensicpathologistdeterminedthatthedecedenthadbeenkilledwithineighthoursoftheOCMEForensicInvestigator'sexaminationofthebody.Thedefendantmaintainedthathehadnoinvolvementinthedemiseofthedecedent.

Thedefendantsaidthatthedecedentdidnothaveanyenemiesorproblemswithanyone,includinghimself.Hereportedthatheandthedecedentaretheonlyoneswithkeystothehouse.Hereportedthatalldoorstothehousehadlocks,includingthefrontdoor.Hefurtherreportedthatthefrontdoor'sdeadboltandsecuritychainwerebothengaged.Thedefendantconfirmedthathedidnotobserveanywindowsdisturbedandthatallwindowscreenswereinintact.HesaidthatheandthedecedentWeretheonlyindividualsinthehousebetween4:00p.m.onAugustIIandthetimehecalled911,andthatduringthisentiretimeheneverheardanynoise,struggle,screams,orcommotion.

Detectivesaskedthedefendantaboutthesignificantagedifference(someforty-fouryears)betweenhimandthe91year-olddecedent.Hesaidthatthemarriagewas"amarriageofconvenience".Thedefendantsaidhedidnothaveaformaljobandthathewasfinanciallysupportedbythedecedent,whoprovidedthedefendantwithamonthlyallowancewhichnettedhim$2,000.However,hesaidthatsherecentlydecreasedhismonthlyallowanceto$1,800.

Youraffianttoldthedefendantthathewasawareofthattherehadbeenotherincidentsofdomesticviolencebetweenthedefendantandthedecedent.Youraffiantaskedthedefendantiftheremayhavebeenanaccidentwhichcausedthedeathofthedecedent.D-lfirmlyresponded,"Itwasn'tanaccident."Detectivesconfrontedthedefendantastowhoelsecouldberesponsibletorthedecedent'sdeathotherthanthedefendant;hisonlyexplanationwasthatitmusthavebeenanintruder.Detectivesremindedthedefendantthatthedoorswerelockedduringalltimesrelevanttothedeath,andthedefendantagreed.Detectivestoldthedefendantthatallthewindowswerelockedaswell,andwhenthedefendantsaidthatsomeofthewindowswereunlockedthedetectivesexplainedthatallthescreenswereintactandnothingappearedtobedisturbed,andthedefendantagreedthattherewasnopossiblewayanyoneenteredthehouse.Thedefendantthenstatedthattheremusthavebeenanintruderifthedecedentwasmurdered.Youraffiantaskedhim,"Howcouldtheycomein?"Thedefendantreplied,"It'syourjobtoinvestigate,notmine."Detectivesaskedthedefendant,"Whowouldhaveamotivetocomeintoharmyourwife?"Thedefendantreplied,"Idon'tthinkanybody."
