The United States District Court for the Southern15District of New York (George B. Daniels, Judge) certified a class16for settlement purposes and approved a settlement agreement17(“Settlement”) over the objection of ten class members18(“objectors”). In this appeal, objectors challenge the propriety19of the Settlement’s release provision, the certification of the20class, and the process by which the district court reached its21decisions. Although we reject objectors’ arguments regarding the22release, we conclude that the district court abused its23discretion in certifying the class and approving the Settlement,24because the named plaintiffs failed to adequately represent the25interests of all class members. We do not reach the procedural26challenges, which are moot in light of our class certification27holding. We therefore VACATE the district court’s order and28judgment and REMAND for further proceedings consistent with this29opinion.30-2-
