Therefore, the parties notified the clerk that no agreement was reached and requested the clerk choose a mediator via blind rotation from the court's list of certified mediators.

ANTONIO ALMEIDA, Defendant. / JOINT NOTICE FOR CLERK TO APPOINT MEDIATOR Plaintiff, IO GROUP, INC., and Defendant, ANTONIO ALMEIDA, by and through their undersigned attorneys, pursuant to the Courts Order of August 2, 2011 (Doc. No. 15), file their Joint Notice for Clerk to Appoint Mediator, stating as follows: 1. On August 2, 2011, the Court issued its Order of Referral to Mediation for the

    above-styled case. (See Doc. No. 15.) In pertinent part, the Order instructed counsel for all parties to agree upon a mediator or, in the alternative, to notify the Clerk that no agreement could be reached. 2. Plaintiff has submitted three names of potential mediators to Defendant for

    consideration, and Defendant has responded, through counsel, that he did not agree to the proposed choices of Plaintiff and would, instead, prefer to have a mediator selected by the Clerk. // // // // //

    Accordingly, the parties hereby notify the Clerk that no agreement has been

    reached and respectfully request that a mediator be chosen, via blind rotation, from the List of Certified Mediators maintained by the Court.
