Inthiscombineddeclaratoryjudgmentaction/Article78proceeding,plaintiff-petitioners(hereinafterpetitioners):challengecertainregulationsadoptedbytheBoardofRegentsonMay16,2011intendedtoimplementtheannualprofessionalperformancereviewofclassroomteachersandprincipalspursuanttoEducationLaw§3012-c.ThepartiesagreethattheenablinglegislationwaspromulgatedaspartoftheState'sinitiativetoobtainanawardundertheUnitedStatesDepartmentofEducation(USDE)"RacetotheTop"(RTTT)initiativechallengingStatestopursuecomprehensivereformintheireducationsystem.Thepartiesfurtheragreethattheyjointlydevelopedtheproposedlegislation.Thedisputecentersontheinterpretationofthestatutethroughthechallengedregulations.EducationLaw§3012-cwasadoptedonMay28,2010,effectiveJuly1,2010andestablishedanewstructurerequiringannualperformanceevaluationsofclassroomteachersandbuildingprincipals(seeL.2010c.103).ShortlyafterthelegislationwaspassedNewYorksubmittedaPhaseIIRTTTapplication.On
'PetitionersaretheNewYorkStateUnitedTeachers(NYSUT),alaborunionrepresentingapproximately600,000in-serviceandretiredteachersandschoolrelatedprofessionals(seeVerifiedComplaint/Petitionatparagraph5),threeaffiliatedlocallaborunions,andtheirrespectivepresidents.Thepresidentsofeachlocalunionarealsotenuredclassroomteachers.2
 
August24,2010,theUSDEannouncedthatNewYorkhadbeenselectedforanRTTTawardof$696,646,000.Theimplementationprocessensued.Byitsterms,theenablinglegislationdirectedrespondentstodevelopimplementingregulations,inconsultationwithanadvisorycommitteerepresentativeofteachersandschooldistricts;nolaterthanJuly1,2011(EducationLaw§3012-c[7]).ThestatutefurtherprovidesthatperformancereviewsconductedafterJuly1,2011bebasedonthisnewprogram(EducationLaw§3012-c[1]).Thesubmissionsconfirmthatanadvisorycommitteeparticipatedintheprocessfordevelopingthedraftregulations(seeExhibit"C"annexedtoAnswer).Ultimately,emergencyregulationswereadoptedonMay16,2011,effectiveJuly1,2011

(seeExhibit"B"annexedtoAnswer).Thischallengeensued.ByOrdertoShowCause(platkin,1.)datedJune27,2011,andinitiallyreturnableJuly11,2011,petitionersappliedforapreliminaryinjunctionenjoiningrespondentsfromimplementingcertainoftheadoptedregulations.
