Goodafternoon.ForthoseofyouaffectedbyHurricaneIrene,ItrustandhopethatyouandyourfamiliesareweHandingoodhealth.Asyouknow,lastFridaytheJudicialSalaryCommissionapprovedsalaryincreasesforNewYork'sJudges.Obviously,Iampleasedthat,evenintoday'sverydifficultfiscalsituation,judgesarefinallygettingraisesaftertwelveyearsofnotevenacostoflivingadjustment,StartingonApril1,2012,NewYorkStateJudges

salarieswillatleaststarttohavesomerationalrelationshiptothesalariesofotherstatejudgesandourfederalcolleagues.Bythesametoken,weareallunderstandablydisappointedthatourjudiciarywasnotmadewhole,notevenclose,forthelong,torturoustwelveyearordealthatwehaveexperienced.Attheveryleast,anapproachbasedonthecostoflivingincreasesthatwelostoverthoseyearswouldhavey.ieldedamoreappropriatesalarylevelthanthatrecommendedbytheCommission.Further,whileIunderstandthebasisonwhichtheCommissioncouldcometotheconclusionthatfederaljudges'salariesshoutdbethetemplateforstatejudicialsalaryincreases,apositionweourselvesadvocatedformanyyearsbeforefederaljudicialsalariesfellbehindtherateofinflation,fairnessdictatedaftertwelveyearsthatanincreasetothatlevel.shouldhavebeenmadeimmediately,withoutanyphase-inperiod.Wepressedwitheverytoolthatwehadforhighersalarylevelsbasedoneitherour
 
lostcostofIivingincreasessinee1999;aurpresentrankinginjudicialsalariespaidaroundtheCountry;anincreasebasedonstateemployeeincreasesoverthelasttwelveyears;oranincreasepremisedonthepresentfederalsalaryleveladjustedforinflation.OurrepresentativesontheCommissionworkedtirelessly,andwithgreatconvictionandpassion,towardsuchanendandultimatelyquiterightlyvotedagainsttheproposalthatwasadoptedbyafourtothreevoteoftheCommission.Iwanttoparticularlyexpressourdeepappreciationtoourappointees,HobertFiskeandKathrynWylde,fortheirdedicatedandcommittedserviceonbehalfoftheJudiciarytotheworkoftheCommission,andalsothankMarkMulhollandforsupportingourposition.ThebottomlineisthatJudgeswillreceivea27..3%ora$37.,300.00increasebyApril1,2014,witha17%ora$23,300.00increaseup-frontonApril1,2012,andanintermediateincreaseonApril1,2013.Thedollarsalaryfigures,forSupremeCourtJustices,insequenceare$160,000.00in2012,$167,000.00in2013and$174,000.00in2014.ThepayforotherJudgeswillberaisedbythesamepercentagesasforSupremeCourtJustices.Thecommissionprocessdidverymuchworkinthesensethatitcreatedaframeworkforrequiringtheotherbranchesofgovernmenttodealwiththejudicialcompensationissuethathadfesteredforsolongwithabsolutelynoactiontakensince1999.Therecanbenodoubtthat,withoutthesalarycommissionlegislation,judicialsalarieswouldnotbeonanyone'sagendainAlbanytodayintheworsteconomicclimateindecades.Clearly,·wearefortunatetohavethisprocessinplacefornowandinthefuture,ratherthanhavingtogohat-in-handtothelegislatureandtheGovernorforyearsonend-2-
 
withoutarationalorlogicalwaytoachieveourends.Theresultwehaveachievedisnotperfectbyanymeans,butIbeli.evethatthenightmareisover.Whilemanyofusmayfindthesalarypackag.eunfairandinadequateinthecontextofthelongwagefreezewehavesuffered,theplainfactofthematteris:withoutthesalarycommissioninplace,whetherornotwelikethefinalnumberorthephase-in,therewouldwithoutquestionbenosalaryincreaseat

formanyyearstocome--period!Wedonotforget,butwecannotliveinthepastorinavacuumremovedfromtheworldaroundus.Theeventsofthedaydonotescapeourattention--thedebtlimitfiascoinWashington,thecreditratingdowngrade,theWallStreetnosedive,unemploymentatextremelyhighlevels,layoffsinourownshop,foreclosures,andthecostcuttingfrenzyinstateandfederalbudgetswithgovernmentsalariesandbenefitsbecomingtheprimepublictarget--thesearetherealitiesoftodaythatframedtheCommission'sconsiderationofajudicialsalaryincreaseforNewYork'sJudges.Whilethetoxiceconomicclimatedearlylessenedthesizeoftheincrease,thenewsalariessetbytheCommissionwillmoveuswellupfromthebottomranksofstatejudiciarysalarieswhenadjustedforthehighcostoflivinginNewYork.Andthefactofthematteris:oursalariesthiscomingApril

nowbealmostonaparwithourcolleaguesin.neighboringnortheasternhighcostofli.vingstates,NewJerseyandPennsylvania,higherthanourcolleagueslnneighboringConnecticutandsignificantlyhigherthanJudgesinMassachusetts,andoursalarieswillcontinuetoincreaseinthefollowingtwoyears.Attheveryleast,NewYorkjudicialsalarieswillnolongerbeoutofwhackwithjudicialcompensationaroundtheCountry.Inrawnumbers,albeitnotadjustedforthecostofliving,wewillwithjustthefirstphaseofthepayincreaseinAprilbepaidmorethanour-3-
