August18,2011TheHonorableDickDurbinUnitedStatesSenateWashington,DC20510DearSenatorDurbin:ThankyouforyourlettertoPresidentObamaregardingtheAdministration'simmigrationenforcementpoliciesandtheDevelopment,Relief,andEducationforAlienMinors(DREAM)Act.ThePresidenthasaskedmetorespondonhisbehalf. Overthepasttwoyears,theDepartmentofHomelandSecurity(DHS)hasestablished clearandwell-reasonedprioritiesthatgovernhowDHSusesitsimmigrationenforcementresources.Theseprioritiesfocusourresourcesonenhancingbordersecurityandidentifyingand removingcriminalaliens,thosewhoposeathreattopublicsafetyandnationalsecurity,repeat immigrationlawviolatorsandotherindividualsprioritizedforremoval.InitiallysetforthinaMarch2010memorandumfromU.S.ImmigrationandCustomsEnforcement(ICE)DirectorJohnMorton,theseprioritieswererecentlyreiteratedandclarifiedinDirectorMorton's June17,2011memorandumregardingtheexerciseofprosecutoriaIdiscretionbyICEpersonnel. Whileadditionalworkremains,wehavemadetremendousprogressinourefforttofocusDHSresourcesontheseenforcementpriorities.OurFY2010statisticsareillustrative.InFY2010,ICEremoved79,000morealienswhohadbeenconvictedofacrimethanitdidinFY 2008.Asaresult,forthefirsttimeeverandduetotheexpansionoftheSecureCommunitiesprogram,over50percentofthealiensremovedbyICEinafiscalyearwereconvictedcriminals.Ofthoseremovedwithnoconfirmedcriminalconviction,morethantwo-thirdswereeitherapprehendedattheborderorwererepeatviolatorsofourimmigrationlaws.Asenforcementdirectivescontinuetobeimplemented,weanticipatethatthesetrendswillincreaseinFY2011.ThePresidenthassaidonnumerousoccasionsthatitmakesnosensetoexpendourenforcementresourcesonlow-prioritycases,suchasindividualslikethoseyoureferenceinyour letter,whowerebroughttothiscountryasyoungchildrenandknownootherhome.Fromalaw enforcementandpublicsafetyperspective,DHSenforcementresourcesmustcontinuetobe focusedonourhighestpriorities.Doingotherwisehindersourpublicsafetymission-dogging immigrationcourtdocketsanddivertingDHSenforcementresourcesawayfromindividualswho poseathreattopublicsafety.Accordingly,theJune17,2011prosecutorialdiscretionmemorandumisbeing implementedtoensurethatresourcesareuniformlyfocusedonourhighestpriorities.Together
