Permit1127.02PERMITTEDUSES.BuildingsandlandinaClassU-7ADistrictshallbeusedandbuildingsshallbedesigned,created,alteredorintendedonlyfortheusesspecificallydesignatedasClassU-7AusesinSection1111.02,exceptthatothersimilarharmoniousandcompatibleuses,asmaybedeterminedbythePlanningandZoningCommissionandapprovedbyCouncil,maybepermitted.Accessoryusescustomarilyincidenttothemainuseslistedaboveshallbepermitted,providedtheyareplannedanddevelopedintegrallywiththemainbuildingandprovidedfurtherthatinnoeventshallanyoneaccessoryuseoranycombinationofaccessoryusesashereinaftersetforthinsubsection(a)exceedatotaloftwentypercent(20%)ofthemaximumgrosssquarefootageofthefloorareaofthemainbuilding.Suchaccessoryusesamongthosepermittedunderthissectionshallinclude:(a)Thesaleofdrugs:thesale,servingandconsumptionoffood,soft

Wirelesstelecommunicationsfacilitiesshallonlybepermittedasanaccessoryuseprovidedsuchfacilitiesarelocatedontheroofofthebuildingcontainingtheprincipalpermitteduse.Antennasmaybemountedonthewallsofapenthouse,exceptwheretheexteriorwallofthepenthouseisflushwiththeexteriorwallofthebuilding.Antennas,otherthandipoleoromni-directionalantennas,whicharemountedonapenthouseshallnotextendabovethepenthouseandshallbescreenedwithpanelsorotherscreeningdevicesdesignedtomatchtheappearanceofthepenthousewallandreducevisibility.(2)Wirelesstelecommunicationsantennas,includingdipoleantennasovertwoinchesindiameter,andsupportstructuresmounteddirectlyontheroofshallnotextendhigherthantwentyfeetabovetheroofandshallbesetbackfromtheparapetorroofedgeaminimumofonefootforeachonefootinelevationabovethetopoftheparapet.Dipoleantennaswhicharetwoinchesorlessindiametermaybeattachedtotherear(inside)oftheparapetwallprovidedsuchantennasdonotextendmorethanthreefeetabovethetopofsaidparapetwall.Allsuchantennasshallbecoloredtominimizevisibility.(3)Roofmountedwirelesstelecommunicationsfacilitiesshallbedesignedtowithstandwindloadsofninetymilesperhour.(4)Wherewirelesstelecommunicationsfacilitiesareproposedtobelocatedonabuildingwheresuchfacilitiesalreadyexist,theapplicantshallprovideassurancesthattheproposedfacilitieswillnotinterferewiththereceiptortransmissionofsignalsbytheexistingfacilities.(5)Equipmentcabinets,switchingequipment,cables,andotherdevicesassociatedwithwirelesstelecommunicationsfacilitieswhicharelocatedonroofsshallbescreenedfromviewfromthepublicright-of-way.(6)Abuildingpermitshallberequiredfortheinstallationofeachwirelesscommunicationsfacility.ThebuildingpermitfeeforwirelesscommunicationsfacilitiesshallbeassetforthinSection1329.03(y).(7)TheBuildingCommissionermay,where
it
isdeterminedthatproposedwirelesstelecommunicationsfacilitiescomplywithallofthecriteriasetforthherein,issueapermitfortheinstallationofsuchfacilitieswithoutreferraltothePlanningCommission,otherwiseapplicationsforwirelesstelecommunicationsfacilitiesshallbereferredtothePlanningCommissionforconsideration.(e)SatellitedishantennassubjecttoChapter1153.(Ord.1997-185.Passed1-20-98.)
