FactsoftheCase
OnJanuary25,2010,theDefendant,CaseyMarieAnthony,withhercounsel,JoseBaez,tenderedapleatotheCourttoall13countscontainedintheInformation.AftertheDefendant'spleawasaccepted,Mr.BaezaskedtheCourttowithholdadjudicationofguiltonallcounts,givePagelof13
 
hercreditfortimeserved,and"duetostatutoryrequirementsgiveherashortprobationaryperiodofapproximatelyoneyearfollowing,and
any
creditfortimeservedthatthecourtwouldgive."AssistantStateAttorneyFrankGeorgerecommendedtotheCourtthattheDefendant
shouldbeadjudicated
guilty
onall13countsandbesentencedtoastraightincarcerativesentence
withnoprobationtofollow.Mr.GeorgesaidthefollowingconcerningplacingtheDefendantonprobation:There'snoearthlypointinputtingMissAnthonyonprobation;which,ineffect,iscommunitysupervision.Sheisbeingsupervised

hoursaday.Sheisinjail.Andshewillbesofortheveryforeseeablefuture,andmaybefortherestofherlife.TheCourtadjudgedtheDefendantguiltyofcounts
1,2,3,6,9,
and

andsentencedhertotimeservedof

days.Noprobationwasorderedonthosecounts.TheCourtwithheldadjudicationofguiltastocounts4,5,7,8,10,
11,
and13andsentencedher
to
oneyearsupervisedprobation.TheDefendantwasalsosentencedonthosecountsto

daysinjailwithcreditfor

days.Concerningwhentheprobationarysentence
was
tobegin,JudgeStrickland,in
his
oralpronouncement,stated:SowhatI'mgonnadoOnthosecountsthatI'morderingprobationandgivingherwithholds--again,that'sCounts

anddistinctcase,CaseNumber48-2008-CF-IS606-AOonthechargesofmurderinthefirstdegreeandotherchargescontainedintheIndictmentAftertheCourtannouncedthesentence,theState,throughMr.George,raisedtheissueconcerningtheDefendant's
probationstartingatanindefinite
timein
the
future.The
Court
repliedbysayingthatitmayhavetotweakit,butitwasunsurehowtohandletheissueotherthanthewayitwasbeinghandled.JudgeStricklandspecificallyindicated:Imayhavetotweakit.I'vebeenthinkingaboutthis,andI'mnotsurehowelsetodoit.Idon'tknowthatit'sthatindefinite,becausethisiscomingupand

willnot--thetrialI'mspeakingofiscomingupwithintheperiodthatI'vegottoworkwith.Sinceit'swithinthefiveyearsthatI'vegottoworkwith,IthinkI'mokay.Tellme
if
youthink--Mr.George,goahead.Mr.GeorgethenstatedthatAssistantStateAttorneyJeffAshtonsuggestedthattheDefendant'sprobationcouldstartthatday
and
theDefendantcoulddoherprobationwhileincarceratedintheOrangeCountyJail.
Mr.
Baezalternativelysuggestedtheproblemcould
be
resolved
by
allowingtheDefendanttobereleasedonbailinherotherpendingcase,thusfreeinghertostartherprobation.Inreplytobothsuggestions,JudgeStricklandsaid,"I'mwillingtoreconsiderandmodifythesentenceifthere'sabetterwayofdoingthis.Ithinkeverybody'sgoalisthesameand--Mr.Baez,anythingelsefromyouonthat,"towhichMr.Baezstatedno.Page3of13
