Drewfiledapetitiontoannulhisacknowledgmentofpaternityandfordamages(fromLashekaDrew),andonOctober27,2009,hefiledanamendedpetitiontodisavowpaternity.TheseactionswerefiledunderthesamesuitnumberastbepetitionbytheDepartmentofSocialServices.OnJanuary13,20]0,thecourtappointedAttorneyKellyLongtorepresenttheminorchild.OnJuly7,20]0,thecourtheard

testimonyandarguments.ThecourtenteredjudgmentagainstDrewfindingthathisactiontodisavowhadprescribed.Astotheinitialactiontoannultheacknowledgmentofpaternity,thecourtnotedthatonlyabirthcertificatewasintroducedintoevidenceandbecausethechildwaslegitimatetherewasnonecessityforanauthenticatedactofacknowledgment,noneofwhichwasshown.FactsInthesummerof2003,MarionDrew,Jr.,andLashekaDrewbeganarelationship.AfterLashekabecamepregnant,sheandMarionmarriedonDecember13,2003.Sixmonthslater,onJune14,2004,K.D.wasborn;Marionsignedthecertificateoflivebirthasthefatherofthechild.Overthreeyearslater,onNovember7,2007,MarionandLashekaDrewweredivorced.ThepetitionfordivorcewasfiledbyMarionandinitheallegedthatonechildwasbornofthemarriage,namelyK.D.Nothingwassaidconcerningcustodyorsupport.Therecordshowsthatthechildlivedwithhismother.Atthehearingtodisavowpaternity,DrewtestifiedthathedidnotquestionhisbiologicalrelationshipwiththechilduntilthechildsupportrulewasfiledinApril2008.Atthattime,DrewtestifiedthathebegantobearthatLashekamayhave.beensleepingwithothermenandthatK.D.wasnothischild.LashekatestifiedthatshegenuinelybelievedMarionwasK.D.'sbiologicalfather.Shetestifiedthatshehad"protected"sexualcontactaroundthetimeofconceptionwithaformerboyfriend.Lashekaalsotestifiedthatduringthetimeofconceptionshehad"unprotected"
