4.Theabovecaptioneddefendantadvertizedinthelocalnewspaperfurnishedapartment/roomtorentinthelocalnewspaperonoraboutApril2011.5.TheplaintiffrespondedtotheadvertisementandaleasewassignedwithoccupancybeginningMarch1,2011.6.Theinitialrentwas$500.00permonth;firstmonthsrent,lastmonthsrentandanequalamountinsecuritywaspaidbytheplaintifftothedefendant;atotalof$1,500.00incashpursuanttothedefendantsdemand.7.Thedefendantstatedheneverissuedreceipts.B.Thedefendantwasshownhisroomintheatticwhichwasentirelywithoutanyfurnitureforcingtheplaintifftosleeponthefloorwithoutasmuchasalamp.9.However,theplaintiffinformedthedefendantthattheSocialSecurityAdministrationforthepurposeoftheplaintiff'sSSIbenefitsneededtoseealease.10.Thedefendantinstructedtheplaintifftodraftaleaseandsignhisnameforhimtothelease.11.Theplaintiffcomplied(seeexhibit)12.Theplaintiffwasthenmovedtothefirstfloorofthisfour(4)storeyhouse.13.Theplaintiff'srentwasincreasedto$600.00permonth.Thisroomwasfurnished.14.Thedefendantrequiredanother$600.00forthefirstmonth'srent;$600.00forthelastmonth'srentand$600.00forsecurity.15.Severaldayspassedandthedefendantleftanoteintheplaintiff'sbedroomdoorwhichstatedthattherentwasincreasedto$640.00.16.Onceagaintheplaintiffwasrequiredtopayfirst,lastandsecurity.17.Theplaintiffwasthentoldtomovetothesecondfloor.

Thesecondfloorapartmentprovidedtheplaintiffisaboutthesizeofawalk-inclosetforwhichtheplaintiffpays$600.00permonthrent.19.Thereisnoroomforasingledresser.20.Thereisoneundersizedcloset.

21.Theplaintiff'sbedisametalframedfuton.22.Thedefendanttheninformedtheplaintiffwithanothernoteintheplaintiff'sbedroomdooronoraboutJuly1,2011thatretroactivetoMay1,2011thereisanassessmentof$40.00permonthforelectricity.23.Astimepassedtheplaintiffbecameawareofcertainbusinesstransactionsandcertainillegalactivitiesinwhichthedefendantwasinvolved.24.Thedefendantthenbeganinvolvingtheplaintiffinthesebusinesstransactionsandillegalactivities.25.Thedefendantattendsamotorvehicle;recreationalvehicle;boat;andothermotorizedortoweditemswhichtakeplaceatawholesalelicensedauctionlocatedinNewHampshire.26.Thedefendantinformedtheplaintiffthatheutilizessomeoneelse'slicensetoattendtheauctiontomakethedefendantspurchases.27.ThedefendantpaysforeverypurchaseinU.S.currency.28.NewHampshirehasnosalestax.29.ThedefendantthentransportswhateverhehaspurchasedinNewHampshiretothedefendant'sresidence,andelsewhere,inwhichtheplaintiffisatenant.30.Massachusettshasa6.25

salestax.31.Inessencethedefendantearnsatotalof12.50%insalestaxalone.32.Thedefendantkeepssomeofwhathehaspurchasedinthedrivewayoftheaboveresidencewherethedefendantdoeseverythingfromrebuildenginestoautobodywork;oilchanges;tiresandbrakesreplacementetc.33.Thedefendanthasnopermitsorlicensetoconductthisbusinessinhisdrivewayoranywhereelse.34.Therestofthedefendant'sitemspurchasedarestoredaroundtheCityofHaverhillandalsoinNewHampshire.35.ThedefendantisneitherlicensedtopurchaseorselltheitemshepurchasedeitherinNewHampshireorinMassachusetts.36.AlltheincomefromthesaleoftheitemshepurchasedandsoldmustbeinU.S.currency.37.AIItheincomethedefendantreceivesinrentmustbeincurrencyalsoandnoreceiptsareprovided.38.Theplaintiffthenbecameawarethatthedefendantwaspurchasingfoodstampsandsellingthemalsoandaskedtheplaintiffifhewouldactonthedefendantsbehalf.39.Theplaintiffdeclined.40.Theplaintiffalsoknowsthatthedefendant,hislive-incompanion,atleasttwoothertenantswerebuyingandsellingcontrolledmedications.
