AbstractThisthesisexaminesthecompatibilityofIslamicmedicaljurisprudencewithpresentday laws,particularlyintheWesternworld.Althoughthereisa resurgence ofinterestinIslam,thereisa paucity ofwritinginthefield.Since Islamismeanttobeasystemof governmentas well as an articleoffaith it isessentialthatthelaws introduced byIslamicgovernmentsdonot violatetheQur'anandPropheticteachings.Duetopracticalconsiderationsthisthesisis limitedtotheexaminationoflegalaspects ofthemainstreamconcerns of responsibilityandmedicalliabilitytogetherwith matters,literally,oflifeanddeathinthefield.Thesematters are: euthanasia,preventionandterminationof pregnancy,reproduction andcloning,andtransplantation.Thenewdevelopmentsinthemanagementoflong-standing issuessuchaseuthanasia andterminationof pregnancy necessitatefreshexaminationofthelaws,codes, or mores governingthepracticeinsecularspheres.Theinnovationsinthefieldsoffertilisationandtransplantationaremorereasontodoso.Thesedevelopments haveleftthe`law'behind,orhavetakenitbytotalsurprise.Themore sointhecaseofIslamiclawasitwasleft behindinmanyimportantareasformanycenturies.
