To amend the Child Care and Development Block Grant Act of 1990 to include providing diapers and diaperingsupplies among the activities for which funds may beemployed to improve the quality of and access to childcare.
 Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Diaper Investment and
4
 Aid to Promote Economic Recovery’’ or the ‘‘DIAPER
5
 Act’’.

SEC. 2. FINDINGS.
1
Congress finds, pursuant to its authority under Arti-
2
cle I and the Fourteenth Amendment of the Constitution,
3
that—
4
(1) access to a reliable supply of clean diapers
5
is a medical necessity for the health and welfare of 
6
infant and toddlers, their families, and child and
7
health care providers,
8
(2) a supply of diapers is generally an eligibility 
9
requirement for infants and toddlers to participate
10
in early childhood educational programs,
11
(3) providing a sufficient supply of diapers can
12
cause economic hardship to needy families,
13
(4) absent access to child care, parents and
14
guardians of infants and toddlers cannot participate
15
in the workforce, thereby causing economic harm to
16
many families,
17
(5) providing diapering systems to needy in-
18
fants and toddlers through child care programs fur-
19
thers the national goals of improved health and sani-
20
tation for families and for staff in early childhood
21
education and child care programs, and
22
(6) making available clean diapers to needy in-
23
fants and toddlers who would otherwise be prevented
24
from participating in child care programs furthers
25
the national goal of safe and quality child care, and

Care and Development Block Grant Act of 1990.

SEC. 3. PROVISION OF DIAPERS AS CHILD CARE ASSIST-
3
 ANCE.
4
The Child Care and Development Block Grant Act
5
of 1990 (42 U.S.C. 9801 et seq.) is amended—
6
(1) in section 658E(c)(3)(C) by adding at the
7
end the following:
8
‘‘Provision of diapers for use by eligible children
9
 within the State who receive or are offered child
10
care services for which financial assistance is
11
provided under this Act is a direct service and
12
shall not be included in administrative costs.’’,
13
(2) in section 658G is amended by adding at
14
the end the following:
15
‘‘These activities include the provision of diapers and dia-
16
pering supplies to enrolled child care providers sufficient
17
for the population of children under the age of three whose
18
parent receives or is offered financial assistance under this
19
 Act.’’, and
20
(3) in section 658P by inserting after para-
21
graph (2) the following:

‘‘(3) D

.—The term ‘diaper’ means an ab-
23
sorbent garment worn by infants and toddlers who
24
are not toilet-trained or individuals who are incapa-
