SupportServicesDivision(hereinafterCSSD)andtheConnecticutDepartmentofCorrection(hereinafterCTOOC).WHEREAS,
eTooe
isrequired
by
PublicAet08-01toestablisha12-bed,staffsecureresidentialtreatmentprogramforSexOffenders;andWHEREAS,
CSSD
isalsorequiredtoestablishsuchaprogramfor12probationers
by
PublicAct08-01;andWHEREAS,CTOOCandCSSDhaveboth,separately,issuedaRequestforProposalforsuchrequiredprogramming;andWHEREAS,bothCTDOCandCSSDselectedthesamecontractorandenteredintojointnegotiationswiththatcontractortodevelopacombined24-bedprogram;andWHEREAS,theselectedcontractor,TheConnection,Incorporated(TCI),hassubmitted6possiblelocationsforthisprogram;andWHEREAS,theCrDOCandCSSDhavedeterminedtheprogramistobesitedonthegroundoftheCorrigan-RadgowskiCorrectionalInstitution;andWHEREAStheTownhastakenanappealofthedismissalofitslawsuitchallengingtheplacementoftheprogramintheTown,andhasagreedtowithdrawitsappeal;nowTHEREFORE,thepartiesagreeasfollows:

Term,TerminationandModification:
1.Asusedherein,
theterm"Program"
refers
totheResidentialSexOffenderTreatmentProgram("program"),whichshallnotexceed24residents,norshalltheProgram's
physical
dimensionsbeexpanded.
2.
The
term"Service
Provider"
shallreferto
Tel
oranysuccessorentitythatoperatestheProgram.
3.ThisAgreement
will
commenceuponfullexecutionofthisdocument,andwillremainineffect,ataminimum,untilJune30,2013unlessfundingfortheprogramiseliminatedpriortothatdate.AfterJune30,2013

eTDOC,eSSDand/ortheTownmayterminatetheagreementeitherby(a)mutualagreement,or(b)
thirty
dayswrittennotice
and
goodcauseshown.ThetermsandconditionsofthisAgreementmaybemodifiedonlybymutualwrittenAgreementbetweenthepatties.Terminationand/ormodificationofthisagreementshallnotrelieveCrDOeorCSSDoftheirobligationstoestablishastaffsecure,residentialtreatmentprogramforsexoffenderspursuanttoP.A.08-01.1.TheCrDOeandCSSDshallkeepCTOOe'sPrisonPublicSafetyCommitteeapprisedoftheircompliancewiththeprovisionsofthisLetterofAgreement(LOA)andgenerallyoftheoperationoftheProgram.ThePrisonPublicSafetyCommitteeshallmakethisastandingagendaitemforeachmeeting.RepresentativesfromParoleandAdultProbationfamiliarwiththeoperationoftheprogramshallattendeachofthesemeetings.

orneartheroadentrancestothefacilityprovidingnoticeoftheexistenceoftheProgram.III.SecurityandEmergencyPlanning1.BeforeadmittingProgramresidentstotheProgram,theCTDOCandCSSDshallestablishwrittenemergencyresponseandsecurityplansfortheProgram,whichplansshallinclude:internalandexternalsecurity,alarms,videosurveillance
and
possibleonsiteelectronicmonitoring,andprovisionsforongoingsecuritycooperationamongtheCTDOC,CSSD,theServiceProvider,theTownofMontvillePoliceDepartmentandtheMontvilleStatePoliceBarracksCommander.
A
copyofsaidproceduresshallbeprovidedtotheMontvilleStatePoliceBarracksCommander.BasedontheCTDOCrequirements,abbreviatedplansmaybeprovidedtoentitiesotherthantheMontvilleStatePoliceBarracksCommander.TheMontvilleStatePoliceBarracksCommanderwillnotbeauthorizedtosharethefullemergencyplanwithotherentities.2.ThesecurityplandescribedintheprecedingparagraphshallprovidethatCTDOCshallincludetheexteriorofthePrograminitsCorriganCIsecuritytours,includingitsperimetersecuritytours.

3.Thesecurityandemergencyplansshallalsoincludeprovisions

CorriganCl(includingitsplansfordealingwithattemptedescapes,escapes,andabsenceswithoutpermissionfromtheProgram).4.RazorwirefencingshallbeinstalledandmaintainedaroundtheentireperimeteroftheProgramandallgatesshallbealarmed.TheareaenclosedbythefenceshallbetheProgramSecurityPerimeter.

SexOffenderTreatmentactivitiesshallbeconductedinsidethefencesurroundingtheProgramSecurityPerimeter.This

includeexerciseandrecreation.
IV.Program
ResidentManagement,Movement
and
Monitoring2.Notwithstandingthepreviousparagraph,Programresidentswillbetakenoff-siteonoccasion,e.g.,forthepurposeofreviewinghousingandemploymentopportunitiesuponreleasefromtheProgram.
3.All
visits
with
Programparticipants
will
beconductedinsidetheProgramsecurityperimeter.
4.
ProgramresidentsshallnotbeallowedoutsidetheProgramsecurityperimeterunlessescorted
by
theServiceProvider,JudicialorDOCstaff,

theeventthattheServiceProvidertransportsaresidentformedicaltreatment,theServiceProvider

DOC,ServiceProviderstaffshallnotremainwiththeresidentaftertheresidentisadmittedtoahospitalorotherextendedcaremedicalfacility.5.Beforeadmittingresidentstotheprogram,DOCandCSSDwillamendthecontractwiththecurrentServiceProvidertoincorporatethetermsandconditionssetf011hherein.DOCandCSSDshallincludethetermsandconditionssetforthhereininanycontractwithafutureServiceProviderthatoperatestheProgramduringthedurationofthisLOA.6.InnocasewillaProgramresidentbepermittedoutsidetheProgramsecurityperimeterunescorted,exceptinthecaseofadmissiontoahospitalorotherextendedcaremedicalfacilityasprovidedabove.Program
