Sample letter to send to landlord in response to unsubstantiated claim for damages. (Also see related claim form that is used with the letter.)

Some landlords in Lubbock (and probably other college towns) have a practice of demanding reimbursements for cleaning or damages that are unsubstantiated. You can use this letter and the associated claim form (see separate document) to help resolve any disputes.

More information is needed to resolve your claim. Your claim lists the following charges:Replace vertical blinds

 The charges for the vertical blinds, trashremoval in the common area, andreplacement of the sofa presumablyrepresent 1/3 of your claim for theseitems, since the common area wasshared by three tenants.Please note that I firmly requested a personal inspection at the timethat I vacated the apartment, but the manager on duty denied myrequest and responded that the apartment would be inspected at alater date.My position on your claim is as follows:

After the tenants cleaned the common area, we had itprofessionally cleaned in even greater detail by a paidhousecleaner. I carefully inspected the unit and ensured that thecommon area was clean and completely free of trash and debriswhen I vacated the unit.

After I cleaned my bedroom, bathroom, and closet, I had itprofessionally cleaned in even greater detail by a paidhousecleaner. The housecleaner and I carefully inspected thebathroom, bedroom and closet and ensured that they were cleanand completely free of trash and debris when I vacated the unit.

I carefully inspected all furniture just before vacating. The sofahad no damage (or wear beyond what was listed on the “move-in” condition report) and certainly did not have a “broken arm”.
4.
 The failing vertical blinds had been reported in a writtenmaintenance request approximately three months before theapartment was vacated. Raiders Pass did not respond to mymaintenance request for the blinds. These particular blinds havea well-known defect that causes the slats to crack around theattachment holes and drop off even when used with great care. The blinds were not misused in any way. Raider’s Pass shouldmake a claim with the blind manufacturer for replacement orrepair.For the above reasons, I am denying your claims at this time. You may request a review of this denial of claims by providing thefollowing documents:
1.
A statement that provides a basic description of the trash thatwas allegedly left in the common area. The description does notneed to go into detail about the contents of the trash, but shouldlist the approximate quantity of trash and the location of thetrash. Please also provide the date and time of the inspectionand the estimated time that was required to remove the trash.
2.
