NATUREOFTHEACTION
1.ThisisacivilrightssuitbroughtpursuanttotheIllinoisCivilRightsActof2003,740ILCS23/5,challengingtheCityofChicago'smethodofdeployingpoliceservicesintheCityofChicago(or"theCity").Thismethodutilizescriteriathatresultinagreaterfrequencyofdelaysindispatchingpoliceofficerstorespondto911callsforserviceinneighborhoodsthatarepredominantlyAfricanAmericanandHispanic("minorityneighborhoodsordistricts?')thaninpredominantlywhiteneighborhoods("whiteneighborhoodsordistricts'"),Delaysindispatchingofficerscausebothlongerresponsetimesandmoredenialsofservicetominorityneighborhoodsascomparedtowhiteneighborhoods.Thus,theCity'Sdeploymentpracticeshavea

MinorityneighborhoodsanddistrictsareneighborhoodsanddistrictswhereAfricanAmericansand/orHispanicscomprisethemajorityofresidents.

disproportionallyadverseeffectonpeoplewholiveinminorityneighborhoods,includingmembersofCANAandtheACLU.Despitethiswell-known,longstandingdisparity,theCityhasfailedtodeploypoliceofficerstominorityneighborhoodsinamannerwhichensuresequal911services.Plaintiffsseekdeclaratoryandinjunctiverelief.2.TheIllinoisCivilRightsActof2003,740ILCS23/5,prohibitslocalgovernmentssuchastheCityfrom"utiliz[ing]criteriaormethodsofadministrationthathavetheeffectofsubjecting[Plaintiffs]todiscriminationbecauseoftheirrace,color,[or]nationalorigin[.]"3.TheCityviolatesthislawthroughitsmethodofpolicedeployment.
THEPARTIES
4.CANAisanon-profit,communityorganizationwhosemembersareresidentsoftheAustinneighborhoodofChicago.CANAfocusesonimprovingAustinbypromotingpublicsafety,beautificationandeconomicdevelopment.5.TheACLUisanon-profit,non-partisan,statewideorganizationwithmorethan20,000membersandsupporters,dedicatedtoprotectingandexpandingthecivilrightsandcivillibertiesenshrinedintheUnitedStatesandIllinoisConstitutions.
In
particular,oneoftheACLU'sprimarypurposesisensuringthatallpersonsaretreatedfairlybyourgovernmentandreceiveequalservicesandbenefits.TheACLUhasmembersthroughoutChicago,includingtheminorityneighborhoodsofAustin,ChicagoLawn,GrandCentral,andEnglewood.6.TheCityisresponsiblefordeployingpoliceofficersthroughouttheCity.
It
isa"localgovernment"subjecttotheIllinoisCivilRightsActof2003.740ILCS23/5.2
 
FACTS
A.HistoricalDisparitiesinPolice911Services7.Forovertwodecades,theCityhasdeployedpoliceacrosstheCity'sdistrictsinamannerthatprovidesfewerresourcestominorityneighborhoodsthanwhiteneighborhoodsasmeasuredbyresponsivenessto911calls.8.Forexample,in1992,areportbytheconsultingfirmBooz,Allen,Hamilton,hiredbytheCitytoconductastudyofChicagoPoliceDepartment(the"CPD")operations,includingofficerdeployment,concludedthattheCPDdidnotdeployofficerstodistrictsinproportionto911callsandcrimerates.Asaresult,thereportfoundthatofficersinbusierdistrictstooklongertorespondtobothemergencyandnon-emergencycallsforservice.Thedistrictswithhighercrime,proportionatelyfewerofficersandlongerresponsetimeswereminoritydistricts.9.A1992studybyUniversityofIllinois,authoredbyprofessorsBarryRundquistandJunghoRhee,showedthatAfrican-Americandistrictshadfewerpatrolsper1,000violentcrimesthanwhitedistricts.10.In1993,theChicagoReporterpublishedanarticleshowingthatpoliceofficershadtorespondtomorecrimesandmore911callsinAfrican-Americandistrictsascomparedtoofficersassignedtowhitepolicedistricts.11.In1993,theIllinoisAdvisoryCommitteetotheU.S.CommissiononCivilRightsproducedareportshowingthatneitherthenumberofadistrict's911callsnorthenumberofviolentcrimesinthatdistrictwererelatedtoasignificantdegreetothenumberofpoliceofficerstheCPDallocatedtothedistrict.Asaresult,African-Americandistricts,whichtendedtohavemoreviolentcrimes,sufferedbecausetheCPDassignedthemfewerpoliceresourcesthanwhite3
