Narrative
On 10/28/11 at 2334 hours, I, Officer Sterling Ekwo, along with Officer Thomas Turechek, were dispatched to 1048 Pearl Street in reference to an assault. Officer Beth McNally and Officer Melanie Patterson arrived at the scene prior to our arrival. Shortly after Officer McNally arrived, she placed the suspect into custody at 2340 hours. Upon arriving, I spoke with Officer McNally. Officer McNally stated when she arrived, people in the office pointed out the suspect, who was identified as Richard Mastic via a Colorado Driver License. Officer McNally stated Mastic was sitting at desk writing a note. Officer McNally stated she asked Mastic to put down his pen for officer safety concerns, but Mastic refused. Officer McNally stated she then placed Mastic into handcuffs. I advised Mastic of his Miranda rights, and he agreed to speak with me. I asked Mastic what happened, and he stated that Elliot Rodstein tackled him. Mastic stated he then asked Elliot why he tackled him. Mastic stated that Elliot then said, "Because you asked me to tackle you." I asked Mastic if he asked Elliot to tackle him, and he stated, "I'm not sure." Mastic stated that Elliot tackled him again, but he was able to wrestle away from Elliot. Mastic stated while he was still on his hands and knees, Elliot's brother, Eric Rodstein, kicked him in the right side of his face. Mastic stated he then asked Eric why he kicked him, and Eric said it was because he tackled Elliot. Mastic stated that he became very angry, due to Eric kicking him and being accused of tackling Elliot, so he tackled Eric. Mastic stated that Eric's head hit the ground, which caused the injury to Eric's head. Mastic stated that he then tried to leave, but Elliot would not let him. Mastic stated that Elliot then ran outside to get help. Mastic stated he then began to write a note about what happened, until Officer McNally arrived. I did not see any sign of injury to Mastic's face that would be consistent with being kicked in the face. I observed that Mastic appeared to be very intoxicated, as his speech was slightly slurred and deliberate, and he had the strong odor of an alcoholic beverage on his breath. Mastic stated that he had been drinking. I then tried to speak with Eric, but he was being treated by paramedics. I observed that Eric had a large cut on his upper left lip, and that the lower part of his left eye was several swollen, and appeared as if it had collapsed inward. There was a large amount of blood on Eric's face, and on the floor under him. Eric was transported to Boulder Community Hospital by Pridemark paramedic Marsha Davis. Officer McNally spoke with Elliot, and told me the following. Elliot stated that he and Eric have known Mastic for approximately three months, when they began to share an office space at 1048 Pearl Street. Elliot stated that he, his brother, and Mastic were drinking at a brewery during the evening of 10/28/11. Elliot stated that at some point during the evening, Mastic began to talk about being a wrestler in the past, and coaching wrestling currently. Elliot stated that while back at office after drinking, Mastic tried to start demonstrating wrestling moves on him. Elliot stated that he tried to defend himself from Mastic's moves, which made Mastic angry. Elliot stated that Eric then tried to step in, in an attempt to calm Mastic down. Elliot stated that Mastic then punched him in the face, then began to attack Eric. Elliot stated that Mastic punched Eric in the face, which caused Eric to the ground. Elliot stated that Mastic then kicked Eric in the face while he was on the ground, at which point he ran outside to get help. Elliot stated he contacted a stranger, Britt, who helped him call the police. Officer McNally stated that Elliot was also very intoxicated. Elliot's lower right lip was swollen, which he stated was a result of being punched by Mastic. I photographed the injury to Elliot's lip. I also photographed the large amount of blood that was on the floor, and a hole in the wall, which Elliot stated was caused by Mastic. Officer Patterson responded to hospital. While at the hospital, Officer Patterson photographed the injuries to Eric. Officer Patterson later told me that she was advised from the Officer Patterson stated she obtained a voluntary written statement from Elliot, but that Eric was not coherent, so he could not provide a statement, or sign a medical release form. Officer Patterson stated she provided Elliot with a victim's rights pamphlet for he and Eric.

Officer Turechek and I transported Mastic to the Boulder County Jail. Officer Turechek noticed that Mastic's knuckles on his right hand were scrapped, and it appeared as if the injuries were new. Officer Turechek photographed the injuries to Mastic's knuckles. Officer Turechek also photographed the right side of his face, and his right elbow, which Mastic stated hurt from being tackled and kicked by Elliot and Eric. While at the jail, I asked Mastic if he would like to complete a voluntary written statement, and answer more questions. Mastic stated he would. I once again advised him of his Miranda rights, and asked him to sign an advisement /waiver form. Mastic then declined to speak any further or write a statement, stating he wanted to speak with a lawyer first. Mastic is booked and lodged at the Boulder County Jail, charged with Assault in the First Degree, for intentionally causing serious bodily injury to Eric Rodstein by means of a deadly weapon (his foot), and Assault in the Third Degree for knowingly causing bodily injury to Elliot Rodstein.

Narrative
On 10/28/11 at approximately 2330 hours, I, Ofc Turechek #10043 and Ofc Ekwo #6774, were on routine patrol in the City/County of Boulder, State of Colorado. We were dispatched to 1048 Pearl Street on a report of an assault that had occurred. I arrived and saw that Ofc McNalley was in contact with a suspect and I proceeded to Britt D. Justa (Justa) who was on the scene of the assault. Justa told me that he was walking by the door of 1048 Pearl Street, when a male party came out and told him he needed to use his cell phone to call the police. Justa gave the male party, later identified as Elliott Rodstein (Rodstein), his cell phone and followed him into the building. Once inside, Justa told me that he saw another male party, identified as Eric Rodstein, laying on the floor and bleeding from the face. Justa said that Eric Rodstein was flopping around like a fish out of water. Justa also told me that he saw another male party, Richard James Mastic (Mastic), sitting behind a desk in the room. Justa said that Mastic was writing on a piece of paper and asked him what his name was. Justa told me that he game mastic his first name of Britt and he noticed that Mastic wrote his name down on the paper. Justa told me that Rodstein told him that Mastic had kicked his brother, Eric Rodstein, in the face and that he had called the police. Justa also told me that Mastic remained very calm and acted as though nothing had occurred. I collected the piece of paper that Mastic was writing on and entered it into property and evidence. On 10/29/11 at approximately 2300 hours, I, Officer M. Patterson, was dispatched to 1085 Pearl Street (City/County of Boulder, State of Colorado) in reference to an assault that had occurred there. Upon arrival, Officer McNalley had already placed the suspect into custody. I went and stood with the victim as we awaited Paramedics. The victim, Eric Rodstein, was seated in a chair behind a desk. He appeared disoriented and I noted that he had blood on his hands, shirt, and jeans. He kept asking "What happened?" and had no recollection of getting assaulted. He lifted his left hand, and started pushing on his upper cheek near his eye socket. I noted that his eye was already bruised and swollen shut. When he pushed on his face, his fingers were pushing deeply into the injured area. I asked him to stop touching his face and await for the paramedics to look at it. Based on my experience with other assaults, I was concerned that he may have a break or fracture. Officer Ekwo asked that I go to the Boulder Community Hospital to take photographs of the Eric's injuries. I observed that the victim's face on the left side was extremely swollen in the jaw and eye area. I attempted to speak with the victim (Eric) but he was extremely incoherent. I listened to the medical staff as they attempted to ask him questions while they tended to his injuries, but he was unable to answer. When he tried to speak, his face was so swollen that we were unable to understand most of what he said. He told us that he couldn't remember his name, date of birth, and didn't know where he was at. He was in and out of consciousness and was unable to write a voluntary statement or sign a medical release form. I provided Eric's brother, Elliot, with a victim rights pamphlet prior to my departure.
