MOTIONFORCHANGEOFVENUECASENO.II-C-000116JUDGEPAULH.MITROVICHKELLYA.COX,DefendantNowcomesthedefendant,KellyA.Cox,byandthroughundersignedcounsel, andpursuanttoR.C.Section2901.12(K)andRule18(B)oftheOhioRulesofCriminal Procedure,herebyrespectfullymovesthisHonorableCourttoissueanordertransferringthiscasetoavenueinsouthernOhiofortrial.AsgroundsforthismotionDefendantstatesthefollowing:1.JudgeCharlesE.Henry,thenamedvictiminthiscase,wasan extremelypopularandwell-respectedmemberoftheGeaugaCounty community.AsamemberoftheOhiolegislatureandthenasajuristontheCommonPleasCourt,JudgeHenryenjoyedpraiseandadmirationfromthecitizensofGeaugaCounty.EvidencefromtheBoardofElectionswilldemonstratethatJudgeHenryreceivedthegreatestvotesduringelections--higherthananyotherpoliticalfigureinGeaugaCounty.Consequently,itislikelytobeimpossiblethatajurycanbeimpaneledinthiscasethathasnotbeentouchedbythetragiclossofJudgeHenry.Inpointoffact,itismorelikelythannotthatthemajorityofjurorswereJudgeHenrysupportershavingvotedforhimasaStateRepresentativeand/oraCommonPleasCourtJudge.SuchascenariopresentsanunfairjurypoolfortheDefendant. 2.TheincidentgivingrisetoJudgeHenry'suntimelydeathhasbeenreportedinallthenewspapers,hasbeenthesubjectofradiobroadcastsandhasbeenpresentedontelevision.JudgeHenry'sfuneral,withthemassiveshowingoffamily,friendsandadmirers,wasalsoreported.SinceJudgeHenry'sdeathlocal newspapershavewrittenaboutJudgeHenry'sextraordinarylifeandgoodwill.FurtherreportshaveaddressedtheinstantprosecutionandhavereportedtheDefendant'sBACreading.GiventhesecircumstancesitishighlyunlikelythatajurycanbeimpaneledthatdoesnothaveknowledgeofJud~eHenry,hisuntimelydemiseandthiscase.EvenwithextensivevoirdireitisunlikelythattheDefendant cansecureafairandimpartialjuryinGeaugaCounty.

herebyrespectfullymovesthisHonorableCourttoissueanorderreferringtheDefendantforamentalhealthevaluationtodeterminehercompetencytostandtrial.Asgroundsforthismotionthefollowingcircumstancesarecitedinsupportofthisrequest:I.Defendanthasalengthyhistoryofmentalhealthtreatmentdatingbackalmosttwentyyears;DuetotheeventsofMay23,2011,DefendantsufferedanemotionalbreakdownresultinginhospitalizationinCleveland;HealthcareprofessionalshaveattemptedtostabilizetheDefendantwiththeassistanceofnumerousmedicationssinceherdischarge;OnOctober6,2011,Defendantwasfoundbyherhusbandintheirhomeinacatatonicstate.Mr.Coxfirstbelievedthathiswifehadsufferedastroke.Defendantwasthereupontransportedbyambulancetothehospital.TheDefendantspenttwodaysinthehospitalwithalldiagnostictestsrulingoutastroke;theultimatediagnosisbeinganemotionalbreakdown;5.Defendanthassufferedfourlikekindepisodessubsequenttohermostrecent hospitalization.Asaresult,theDefendant'shusbandhasassumedthecare ofthehomeandthecouple'schildrenastheDefendantfrequentlystaresintospace,shakesandcries; 6.DefensecounselhasrecentlytriedtoconversewiththeDefendantabouthercase,butDefendant'smentalconditionappearstobeaseriousimpedimentwiththatendeavor;
