OG&E DATA PROTECTION PLAN OUTLINE
1.
 
Defined terms (to include):a.
 
“Aggregate usage data” means any usage data from which all identifyinginformation has been removed such that the individual usage data of a customercannot without extraordinary effort and expertise be associated with theidentifying information of that customer;b.
 
“Customer” means an individual or a business partnership, limited liabilitycompany, corporation, or other legal entity receiving service from an electricutility in the name of the individual or the entity. A customer may be residential,commercial or industrial;c.
 
“Customer-identifiable usage data”
 
means usage data that is stored or presented ina format that associates the usage data with identifying information of a customeror could be manipulated to identify a customer without extraordinary effort;d.
 
“Customer information” means both identifying information and customer-identifiable electric usage data. Aggregate usage data shall not be consideredcustomer information;e.
 
“Identifying information” means any information that directly or indirectlyidentifies or is uniquely associated with a customer or an authorizedrepresentative of a customer, including but not limited to the name, social securityor taxpayer identification number, street address, telephone number, electricutility account number, meter number, or financial account information of thecustomer or authorized representative of the customer;f.
 
“Nonstandard usage data” means any usage data that is not standard usage dataor aggregate data;g.
 
“Standard usage data” means the internal usage data, as defined in paragraph d,above, that is generally made available by the electric utility to customers in eachof its customer classes on a regular basis, delivered by the electric utility in astandard format and with standard frequency, including without limitation, theusage data collected by the meter and/or obtainable on an as available basis by thecustomer; andh.
 
“Usage data” means information, on an as available basis, relating to both theamount of electricity consumed at a residence or premises of a customer, and thecharacteristics of that consumption, as generated, recorded, stored or transmittedby the electric utility infrastructure or supporting technology.2.
 
Requirements that OG&E will:

provide reasonable access to customer information and maintain theconfidentiality thereof.b. upon request, provide customers with a copy of or access to standardusage data as a component of basis service provided by the utility (withoutadditional cost to the customer)c. upon written request, provide customers non-standard usage data forwhich a reasonable fee, as authorized by the APSC, may be charged.3.
 
Provisions that OG&E may:a. utilize, without customer consent, customer identifiable usage data forinternal business purposes, including but not limited to:1. Provision of services in an effective and efficient manner;2. Collection of charges and other fees from customers for servicesprovided;3. Planning, operation, maintenance, repair or optimization of the electricutility infrastructure; and4. Development, enhancement, marketing, provision of energy-relatedproducts and services or promotion of public policy objectives.5. Use customer information for marketing, provision of energy relatedproducts and services or promotion of public policy objectives.b. provide customer information without customer consent to affiliates and thirdparties, under contract, assisting the utility in providing regulated services orotherwise carrying out its business objectives, provided that third parties shall bebound by the confidentiality requirements for customer data that are applicable toOG&E.c. disclose customer data to third parties in the following circumstances:1. As required by law;2. Pursuant to a warrant, subpoena duces tecum, or other court order;3. In the event of a business transaction such as a merger, acquisition, saleof assets, or similar transaction involving the electric utility;4. In the event of an emergency situation; or5. When the customer provides written consent to the disclosure.d. aggregate usage data for internal business purposes without customer consentand aggregated usage data and make such aggregated data available to the publicfor purposes of promoting energy assistance, conservation environmental advocacyresearch or measuring company performance.
