CITY OF FAIRVIEW PARKORDINANCE NO. 11-50ORIGINATED BY: THE LAW DEPARTMENTREQUESTED BY: MAYOR EILEEN PATTONSPONSORED BY: COUNCILWOMAN CLEARYAN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF FAIRVIEW PARK,OHIO, TO ENTER INTO A CONTRACT WITH THE INTERNATIONAL ASSOCIATION OFPROFESSIONAL FIREFIGHTERS, LOCAL 1057, AFL-CIO AND DECLARING ANEMERGENCYWHEREAS, the Administration has conducted extensive negotiations with the International Associationof Professional Firefighters Local 1057, AFL-CIO as the bargaining representative for certain employeesof the Fire Department; and,WHEREAS, such negotiations have provided a tentative agreement between the parties; and,WHEREAS, the Administration has reviewed such proposal; recommends it to Council; and requests thatCouncil ratify and adopt such Agreement.
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRVIEWPARK, COUNTY OF CUYAHOGA AND STATE OF OHIO:
SECTION 1. That the Mayor be and is hereby authorized to enter into a contract with the InternationalAssociation of Professional Firefighters Local 1057, AFL-CIO on behalf of certain employees of the FireDepartment, a copy of which is attached hereto as “Exhibit A”, with such revisions that may be made bythe Director of Law and approved by the Mayor without altering the substance thereof.SECTION 2. It is found and determined that all formal actions of this Council concerning and relating tothe adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberationsof this Council and any of its Committees that resulted in such formal action were in meetings open to thepublic in compliance with all legal requirements.SECTION 3. That any and all ordinances in conflict with the express provisions of this Agreement aresuperseded by this Agreement.SECTION 4. That this ordinance is hereby declared to be an emergency measure, necessary for theimmediate preservation of the public peace, health, safety and welfare and for the further reason that itwill immediately comply with the terms of the agreement, and provided it receives the affirmative vote of majority plus one of members elected to Council, it shall take effect and be in force immediately upon itspassage and approval by the Mayor, otherwise from and after the earliest period allowed by law.PASSED: 11-07-11APPROVED: 11-07-11 ___________________________________Michael P.
