This Court has jurisdiction pursuant to 28 U.S.C. §§ 1331, 1334, and 1367.
FACTUAL AND PROCEDURAL BACKGROUND
On January 14, 2009, Plaintiffs filed the complaint in this action against theCity and Defendant County of Los Angeles ("the County") (collectively,"Defendants") alleging four causes of action: (1) violation of Title II of theAmericans with Disabilities Act ("ADA"); (2) violation of Section 504 of theRehabilitation Act of 1973 ("Section 504"); (3) violation of the CaliforniaDisabled Persons Act ("CDPA"), California Civil Code § 54,
and (4)violationof California Government Code § 11153.
[Doc. No. 1.] The disputeconcerns whether Defendants' emergency preparedness programs adequatelyserve the needs of the more than 800,000 individuals with disabilities who livewithin the jurisdiction of the City. (Plaintiffs' Memorandum of Points andAuthorities in Support of Motion for Summary Judgment ("Pis.' ) Plaintiffs contend that theseindividuals suffer discrimination as a result of their disabilities becauseDefendants' emergency preparedness programs fail to address their unique needs.(Pis.' Mot. for Summary Judgment at 2:13-15, 17:21-23.) Due to their exclusionfrom such programs, Plaintiffs further maintain that they are disproportionately
