RegulatoryAffairs)onthebehalfofcellularindustryvideemaildated19Oct2011.2.Article14oftheConstitutionofIslamicRepublicofPakistan,providesthat
"thedignityofmanand,subjecttolaw,theprivacyofhomeshallbe
inviolable",
Accordingly,underArticle19oftheConstitutionithasbeenprovidedthat
"everycitizenshallhavetherighttofreedomofspeechandexpression,freedomofthepress.subjecttoanyreasonablerestrictionsimposedbylaw....".
3.Thecourtswhileinterpretingarticles14and19oftheConstitutionhaveconstruedthatthoughunderArticle19oftheConstitutionoftheIslamicrepublicofPakistanfreedomofspeechisafundamentalrightwhichprovidesthateverycitizenshallhavetherighttofreedomofspeechandexpression,andthereshallbefreedomofthepress,subjecttoanyreasonablerestrictionsimposedbylawintheinterestofthegloryofIslamortheintegririty,securityordefenceofPakistanoranypart
thereof,
friendlyrelationswithforeignStates,publicorder,decencyormoralityorinrelation
 
4.Clause(d)ofsub-section
(1)
ofsection31ofthePakistanTelecommunication(Re-organization)Act,1996providesthatwhoever"unauthorisedlytransmitsthroughatelecommunicationsystemortelecommunicationserviceanyintelligencewhichheknowsorhasreasontobelievetobefalse,fabricated,indecentorobscene"isanoffenceundertheAct.

providedunderArticle14oftheConstitution,thatdignityofman,subjecttolaw,theprivacyofhomeareinviolable.Suchprincipleisrequiredtobeextendedfurthertothecasewhereanydefamationiscaused,becausehumandignity,honorandrespectismoreimportantthancomfortsandnecessities.Noattemptonthepartofanypersonindividually,jointlyorcollectivelytodetract,defameordisgraceotherperson,therebydiminishing,decreasing
and
de-gradingdignity,respect,reputationandvalueoflife.Whileexercisingrightoffreedomofspeechandexpression,onehastokeepinhismindthathe
has
alsoacorrespondingresponsibilityanddutytoensurethathisfreedomofexpressionorspeechmaynottransgresslimitsoffreedombeyondtheboundariesofArt.14oftheConstitution."

"thetransmissionofharmful,fraudulent,misleading,illegalorunsolicitedmessagesinbulktoanypersonwithoutexpresspermissionoftherecipient,orcausinganyelectronicsystemtoshowanysuchmessageorisbeinginvolvedinfalsifiedonlineuseraccountregistrationorfalsifieddomainnameregistrationforcommercialpurpose"
Thereforetheconstituentsofa'spamming"messageshallbeasfollows:(a)
'harmful",
'fraudulent"misleading','illegal'or'unsolicited';and(b)in'bulk'(bulkhasbeenspecifiedbytheAuthorityinclause1.6oftheSOPtocontrolspamming)(c)'withoutexpresspermissionofrecipient'(d)'forcommercialpurpose'.6.Withrespecttoprivacyofcommunicationthecellularmobilelicenseunderclause7.6.1providesthat
