TOTHEHONORABLECOURT:DefendantCarolynMcClainobjectstotheSpecialCommissioners'Awardintheabove-referencedcondemnationproceedingrenderedonOctober27,2011,andfiledwiththeCourtonNovember1,2011,andwouldrespectfullyshowtheCourtasfollows:
I.
McClainobjectstotheCommissioners'Award,andPlaintiff'scondemnationpetition,becausePlaintifflacksauthoritytocondemnMcClain'sproperty,inthatthetakingPlaintiffseeksisnotwithinthestatutorydelegationofPlaintiffseminentdomainpowers.
II.
McClainobjectstotheCommissioners'Award,andPlaintiffscondemnationpetition,becausePlaintiffhascommittedaclearabuseofitsdiscretionindeterminingthatanecessityexistsforthetakingofMcClain'sproperty,inthatnopublicnecessityhasbeensuggestedorcanbeshownfortakingthatproperty.
III.
McClainobjectstotheCommissioners'Award,andPlaintiff'scondemnationpetition,becausetheuseforwhichPlaintiffseekstotakeMcClain'spropertyisnotapublicuse,inthatthe

propertyistobeusedasaprivatelocationfortheusebyPlaintifforothers.IV.McClainobjectstotheCommissioners'Award,andPlaintiff'scondemnationpetition,becausePlaintiffdoesnotseekMcClain'spropertyforarecognizedpublicuseorpublicnecessityasestablishedbyTexaslaw.TEX.GOV'TCODE§2206.001(b)prohibitstheCityofDallasfromtakingpropertyviaeminentdomainifthetakingconfersaprivatebenefitonaparticularprivatepartythroughtheuseoftheproperty,isforapublicusethatismerelyapretexttoconferaprivatebenefitonaparticularprivateparty,orisforeconomicdevelopmentpurposes.PlaintiffsstateduseforMcClain'spropertyviolatesatleastoneofthoserestrictions.
V.
McClainobjectstotheCommissioners'Award,andPlaintiff'scondemnationpetition,becausethetakingofMcClain'spropertybytheCityisnotnecessaryforthecompletionofthehotelproject.TheMcClainpropertyisnotessentialtotheoperationandfunctionoftheconventioncenterhotel,asevidencedbythehotelopeninginafewdays'hence.TheCitydoesnotneedtocondemnandtaketheMcClainpropertytocompleteitsproject.ThetakingunnecessarilyeliminatesthevalueofthepropertyandthebenefitsMs.McClainenjoysbyowningtheproperty,includingbutnotlimitedtoherrightsaslessorofthepropertypursuanttoa99-yeargroundlease.Thus,Ms.McClainchallengestherighttotake.VI.McClainobjectstotheCommissioners'AwardbecausethecompensationawardedbytheSpecialCommissionersintheawardofOctober27,2011isinadequateandfailstocompensateMcClainfullyandadequatelyforthereasonablevalueofMcClain'spropertytakenanddamaged.

VII.McClainobjectstotheCommissioners'Awardbecausetheamountofdamagesawardedbythespecialcommissionersisgrosslyinadequate,inthatitfailstocompensateMcClainfullyandadequatelyforthereasonablevalueofMcClain'spropertytakenanddamaged.VIII.McClainobjectstotheCommissioners'Awardbecausethespecialcommissionersfailedtousethepropermeasureofdamagesinarrivingattheiraward,including,amongotheritems,thefailuretoapplytheincomeapproachorotherwiseassignavaluetoMcClain'sleaseonthepropertybeingtakenbyPlaintiff.IX.Totheextentnecessary,McClaindenieseachandeveryallegationmadeinPlaintiffsAmendedStatementinCondemnation,whichisonfileinthiscauseandtowhichreferenceisheremadeforthepurposeofascertainingthestatementsandallegationsdeniedbyMcClain,anddemandsthatPlaintiffberequiredtoproveeachsuchstatementandallegation,orinthealternative,Ms.McClainstatesthatsamecanbeproventobeuntrue.

McClainfurtherseeks,shouldthiscondemnationactiongoforward,anawardofherreasonableandnecessaryattorneys'fees,costs,appraiserfees,andallotherfeesasallowedunderTEX.
