Employeeswithlessthansevenyearsofstateserviceshallreceivefourmonthsofwages,calculatedatthetopstepoftheirwageclassification,plus$6,000(couldbeusedforCOBRA,lostvacationorannualleaveaccumulation,etc.).Theattachedfistoftheclassificationseligibleforthetransitionpackagealsoindentifiestheamountofcompensationemployeesineachclassificationareentitledtoreceive.4.StateFundshallnotdisputeanyvalidclaimforUnemploymentInsurancebenefitsfromemployeeswhohaveacceptedtheTransitionPackageinthescopeofthevoluntarylayoff.StateFundagreesthatreceiptofaTransitionPaymentdoesnotrenderaclaimforUnemploymentInsuranceinvalid.5.EmployeeswhoacceptthetransitionpackagemustsignawaiverfortheremainderoftheirSROAstatusshouldanyremainingstatusexist,andawaiveroftheirrighttobeonthere-employmentJist,andrecognitionthatTransitionPaymentsarenotfinalcompensationandnotsubjecttopenalties.

E.ThepartiesagreethatthisAgreementisintendedtoaddressthematterssetforthherein.Thepartiesalsoagreethatitisnotintendedtorestrictorprohibitinanywayanyfuturenegotiationsbetweenthepartiesunderapplicablelaw.ThepartiesagreethatnothinginthisAgreementshallbeconstruedasawaiverofLocal1DDD'srighttobargainovertheStateFundreductioninforce,ortoenforcetheAgreementbetweenStateFundandSEIULocal1DaD'sThree-YearStrategicPlan("Three-YearPlanAgreement"),oranyothermattersunderthescopeofrepresentationunderapplicablelaw.F.DisputeResolution:Anydisputeregardingtheinterpretation,applicationorallegedviolationofthisAgreement/sidelettershallbesubjecttothegrievanceandarbitrationprocedureoftheparties'currentcontract.However,thefollowingprovisionsshallapplyandprevailifinconsistentwiththatprocedure.SEIULocallODOishereafterreferredtoastheLocal1DDDandStateCompensationInsuranceFundasStateFund.1.ExpeditedGrievancesThepartiesagreethatallviolationsofthisAgreement/sidelettershallbefileddirectlyatsteptwo(2)/departmental(StateFund)levelofthegrievanceprocedure.Allothertlrnelinesshallapplytothegrievanceexceptthefollowing:a)Withinfifteen(15)calendardaysafterreceiptofthegrievance,StateFundgrievanceresponderordesigneeshallrespondinwritingtothegrievance.b)Withinfifteen(15)calendardaysaftertheStateFund'sresponseisreceived,theLocal1000mayelevatethegrievancetotheDepartmentofPersonnelAdrninlstratlon(DPA).c)Withinfifteen(15)calendardaysafterreceiptoftheappealedgrievance,theDirectorofDPAordesigneeshallrespondinwritingtothegrievance.d)Withinfifteen(15)calendardaysafterreceiptoftheDPAresponse,LocallODOmayrequestarbitrationbyservingnoticeontheState,andshallcontacttheStatetomutuallyselectanarbitrator.IftheStatefailstorespondtotherequestorthepartiescannotmutuallyagreeuponanarbitratorwithinten(10)calendardaysaftertherequesttoselectanarbitratorhasbeenserved,Local1DOOmayrequesttheStateMediationandConciliationServicetosubmittobothpartiesapanelofnine(9)arbitrators.Withinten

calendardaysafterreceiptofthepanelofarbitratorsfromtheStateMediationandConciliationService,Local1DDOshallcontacttheStateinwritingandrequesttostrikenamesfromthepanel.Thepartiesshallhavefive(5)businessdaystomeetandalternatelystrikenamesuntilonlyone(1)nameremainsandthispersonshallbethearbitrator.IftheStateorLocal1DOOfailstomeetandstrikenames,theotherpartyshallselectanarbitratorfromthelist.
