CriminalPossessionofaWeaponintheFirstDegreeasaCrimeofTerrorism
Thedefendant,onNovember19,2011,possessedanexplosivesubstancewiththeintenttousethesameunlawfullyagainstthepersonandpropertyofanother,asaCRIMEOFTERRORISM,committedwithintenttointimidateandcoerceacivilianpopulation,toinfluencethepolicyofaunitofgovernmentbyintimidationorcoercion,andtoaffecttheconductofunitofgovernmentbymurder,assassination,andkidnapping;and
ConspiracyintheSecondDegreeasaCrimeofTerrorism
Thedefendant,frominoraboutSeptember2011toinoraboutNovember2011,withintentthatconductconstitutingthecrimeofCRIMINALPOSSESSIONOFAWEAPONINTHEFIRSTDEGREE,aclassBFelony,beperformed,agreedwithanothertoengageinandcausetheperformanceofsuchconduct,asaCRIMEOFTERRORISM,toinfluencethepolicyofaunitofgovernmentbyintimidationorcoercion,andtoaffecttheconductofunitofgovernmentbymurder,assassination,andkidnapping;andcommittedwithintenttointimidateandcoerceacivilianpopulation;and
SolicitingorProvidingSupportforanActofTerrorismintheSecondDegree
Thedefendant,onoraboutOctober2010throughNovember2011,withintentthatmaterialsupportandresourceswouldbeused,inwholeandinpart,toplan,prepare,carryout,andaidinanactofterrorismandtheconcealmentof,andanescapefrom,anactofterrorism,thedefendantraised,solicited,collected,andprovidedmaterialsupportandresources;and
CriminalPossessionofaWeaponintheThirdDegree
Thedefendant,onoraboutNovember19,2011,committedthecrimeofCRIMINALPOSSESSIONOFAWEAPONINTHETHIRDDEGREEpursuanttosubdivisionsone,two,three,orfiveofPenalLaw265.01,havingbeenpreviouslyconvictedofacrime;and
ConspiracyintheFourthDegree
Thedefendant,frominoraboutSeptember2011toinoraboutNovember2011,withintentthatconductconstitutingthecrimesofCRIMINALMISCHIEFINTHEFIRSTDEGREE,aclassBFelony,andARSONINTHETHIRDDEGREE,aclassCFelonybeperformed,agreedwithanothertoengageinandcausetheperformanceofsuchconduct,andTheoffenseswerecommittedunderthefollowingcircumstances:IamadetectiveassignedtotheIntelligenceDivisionoftheNewYorkPoliceDepartment,wheremydutiesforthepast10yearshaveincludedtheinvestigationandmonitoringofterroristorganizations.Duringthattime,Ihavereceivedspecialtrainingandhavebecomeveryfamiliarwiththeworkingsofterroristorganizationsandofindividualswhoplottocommitterroristacts.
Overapproximatelythepast12months,togetherwithfellowofficers,Ihaveconductedalong-terminvestigationofthedefendant'splanstoconductaterroristattackinNewYork.DuringthattimeIhavereviewedinternetpostingsfromthedefendant,bothonawebsitemaintainedbyhimandonblogs,inwhichthedefendantdescribedhissupportoftheterroristorganizationAlQaedaandhisbeliefinviolentjihad.IhavealsoreviewedaudioandvideorecordingsofthedefendantdiscussinghisplanstobuildabombandtouseabombtoassassinateU.S.servicemenandwomenreturningfromactivedutyinIraqandAfghanistan.Theseconversations,mostofwhichwereaudiorecorded,involvedthedefendantdiscussinghisplanswithaconfidentialinformant(the"CI")underthecontroloftheNYPD.IhavealsohadnumerousconversationswiththeCI.Becausethisaffidavitissubmittedforthelimitedpurposeofestablishingreasonablecausetobelievethatthedefendantscommittedthecrimescharged,Ihavenotsetforthallofthefactsdevelopedduringthecourseoftheinvestigation.Inaddition,theconversationsasreportedareinsumandsubstance.SinceatleastOctober2010,defendantJOSEPIMENTELhasmaintainedthewebsitewww.trueislam1.com(formerlyTrueislam12.blogspot.com)("TrueIslam"),whichIhavereviewedonnumerousoccasions."TrueIslam"containsalink,entitled"MakeaBombintheKitchenofYourHome,"whichallowstheviewertodownloadaPDFfilewithdirectionsonbuildingabombathome.ThePDFfileisanarticlefromtheon-linemagazine,"Inspire"called"MakeaBombintheKitchenofYourMom."IamfamiliarwithInspireMagazinefrommytrainingandexperienceincounter-terrorismwork.
It
isanonlinemagazinecreatedanddisseminatedbyAlQaedawiththespecificgoalofinspiringradicalMuslimsthroughouttheworldtoengageinactsofviolenceagainsttheWest.IhavereviewedthisPDFfile,anditprovidesstep-by-stepinstructionsonhowtobuildabombdesignedtomaximizecasualties.Finally,IhavereviewedbusinessrecordsfromGoogleshowingthat"TrueIslam"ismaintainedbyGoogleInc.,andthatdefendantistheownerofthe"TrueIslam"account."TrueIslam"stronglyadvocatesthecommissionofviolenceagainstUnitedStatescitizens.Forexample,anarticlewaspostedentitled"WhyUsamahIbn("sic")LadenistheLeaderoftheBelievers."Thisarticlestates,inpart,"PeoplehavetounderstandthatAmericaanditsalliesarealllegitimatetargetsinwarfare.Thisincludes,facilitiessuchasarmybases,policestations,politicalfacilities,embassies,CIAandFBIbuildings,privateandpublicairports,andallkindsofbuildingswheremoneyisbeingmadetohelpfundthewar."IhavereviewedrecordingsofmultipleconversationsbetweentheCIanddefendantonSeptember7,2011,inwhichthedefendantclearlyexpressedhisinterestinbuildingsmallbombsandtargetinggovernmentestablishments,policebuildings,andbanks.OnoraboutSeptember29,2011,defendantdeliveredtotheCIaflashdrivecontainingsixissuesofInspireMagazine,theInspireMagazinearticlediscussedabove,a417pagemanualentitled,"OrganicChemistryofExplosives,"anda374pagemanualentitled,"ThePreparatoryManualofExplosives."
