— ORDER DENYING VERIFIED COMPLAINT
AND PETITION FOR WRIT OF HABEAS CORPUS
THIS MATTER came before this court in her capacity as emergency/duty judge,
without hearing, on review of the pro se Petitioner's Verified Complaint and Petition for
Writ of Habeas Corpus, filed on August 15,2007. On review of the complaint, court
record, and applicable law, this court finds as follows:
This court finds that the relief sought by the Petitioner should be brought in a
proper pleading filed in the parties’ open dissolution of marriage case, no. 2004-DR-
4764-WS. It appears, from a review of the file docket, that an amended final judgment of
dissolution of marriage establishing custody was entered on November 7, 2005. Further,
there has been record activity in that file as recently as June 2007. Therefore, this court
concludes that the filing of a separate civil action seeking custody can only be
characterized as an attempt by Petitioner at "judge shopping.
Accordingly, it is _
ORDERED AND ADJUDGED that Complaint and Petition for Writ of Habeas
Corpus is hereby DENIED.
