CONDITIONS OF RENTAL AND USE


1. 2. The club house is rented to residents based on a first come, first served basis. The Association reserves the right to refuse to rent to anyone for any reason and/or to anyone that cannot provide proof that they are either a homeowner in good standing with the Association or a tenant (copy of lease agreement) on file with the Association upon request. There is a NON-REFUNDABLE Rental Fee of $150.00 made payable to Retreat at Twin Lakes HOA to confirm your reservation. Cancellation of a reservation up to 24 hours in advance of the scheduled event is permitted and a full refund of the rental fee will be made. There is a $200.00 Security Deposit, made payable to Retreat at Twin Lakes HOA, required to be submitted with the rental application in addition to the Rental Fee of $150.00. The Security Deposit will be refunded if the club house and surrounding amenity center grounds are free of any trash and debris or damage to facilities. Separate checks for the Rental Fee ($150.00) and the Security Deposit ($200.00) must be provided with the application or the application will be returned as incomplete. Reservations will not be confirmed without a rental fee payment or a security deposit. Cash or credit cards are not accepted. The club house rental and use agreement, rental fee, and security deposit must be received by the Association fourteen (14) business days before the requested event date. The maximum time permitted for any one event is four (4) hours. If your event starts late, you must still vacate the club house at the time you have listed to end your event. Hours of operation and use of the club house are from 8:00 a.m. to 9:00 p.m. seven days a week. Events can only be held during the hours of operation. The Association will hire and provide an off duty police or security officer on site at the club house and surrounding area during the entire time of your scheduled event. The officer will have the full authority to enforce the club house rental and use conditions as well as all HOA Rules and Regulations anywhere in the community, including the club house, common areas and street parking.

The use of the club house for private parties does NOT extend to the pool or common grounds in the community. No alcoholic beverages can be served at any time in the club house or anywhere on HOA common grounds. The presence of any alcohol or drugs will be cause for the rental and use of the club house for such event to be terminated immediately. Smoking in the club house is not permitted, nor are any guns or firearms permitted. Anyone found smoking in the club house, the pool area or surrounding club house property will be asked to leave the area. Children under the age of 14 must be accompanied by an adult resident over the age of 18 continuously. The event host must be a homeowner in good standing or a resident in the association that must be present at the event to supervise all activities continuously. The event host must meet with the designated Association representative at the start of the event and at the end of the event. After the event the designated Association representative will inspect the facility to make sure it has been returned to the same condition it was in before the event. The HOA reserves the right to cancel or reschedule an event if there is a conflict. The homeowner or resident signing the rental and use agreement will be responsible for any damage to the facility, cleaning up the facility and any common areas after the event and removing all decorations and properly disposing of garbage from the club house facility and common areas. The maximum number of occupants of the club house is thirty (30) individuals at any one time. If the HOA determines the facility is left in a clean and orderly manner after the event the reservation security deposit check will be returned to the homeowner within fourteen (14) days after the event. Once your reservation request and deposit check is received you will receive a confirming email indicating whether the date and time you have requested is confirmed. You need to have the email reservation confirmation response with you during your event in case you are requested to provide written confirmation of your reservation. Failure to provide written proof of a reservation confirmation upon request will be cause for the Association representative to terminate or cancel any event. If any clubhouse or HOA rules are violated as part of your event, if the facility is damaged or not returned to a clean state, or if your event runs over your listed End time, your deposit will be forfeited. Your use privileges for future events may also be suspended. Pool patio furniture or tables cannot be removed from the pool patio area for use inside the club house for any event. Parking for private parties is limited to the available parking spaces in the front of the club house only. There is no other over-flow parking for club house events in the community. The homeowner or resident signing the rental and use agreement is responsible to obtain permission to park vehicles on other property outside of the community if the number of vehicles exceeds the number of available club house parking spaces. Parking on vacant lots is not permitted. Any vehicle parked in such a manner as to be considered to impede traffic or to cause a safety concern within the community will be towed by the Association at the homeowners or residents expense.
