12/01/11Rolando McClain has been arrested by the Decatur Police Department in connectionwith an assault which occurred late Wednesday night. The victim in the assault reportedthat he had been at a residence on Skyview St. SW in Decatur when he got into a fightwith another individual, identified as Jerradius Willingham. During the fight, the victimsustained injuries to his head and face. He was bleeding from the nose and mouth whenspeaking to the responding officers. The victim told officers that following the fight, hecrawled to his car. He said that when he reached his car, Rolando McClain produced a pistol and aimed it at him. He said that while he was still on the ground, McClainwalked over to him and put the gun to his head. The victim reported that he beggedMcClain not to shoot him and that McClain took the gun away from his head, held itnext to his ear and fired it. Even though the initial report was of “shots” fired,investigators believe this was the only gunshot fired.For most misdemeanor offenses, officers can only make an arrest if the offense occurredin their presence. For this reason, officers did not charge McClain or Willingham at thescene. The officers filed a report and informed the victim that he would be contacted byinvestigators the following morning. After filing a report with the officers, the victimdrove himself to the hospital.Earlier today, investigators met with the victim and assisted him in obtaining personalwarrants for McClain and Willingham. At this time, Rolando McClain has been chargedwith Assault in the Third Degree, Menacing, Reckless Endangerment, and Discharginga Firearm Inside the City Limits. He is currently being held in the Decatur Jail until his bond of $2,000.00 is paid. Jerradius Willingham has been charged with one count of Assault in the Third Degree and has been released on $500.00 bond.

Section 13A-6-22
Assault in the third degree.
(a) A person commits the crime of assault in the third degree if:(1) With intent to cause physical injury to another person, he causes physical injury toany person; or (2) He recklessly causes physical injury to another person; or (3) With criminal negligence he causes physical injury to another person by means of adeadly weapon or a dangerous instrument; or (4) With intent to prevent a peace officer from performing a lawful duty, he causes physical injury to any person.(b) Assault in the third degree is a Class A misdemeanor.

Menacing.
(a) A person commits the crime of menacing if, by physical action, he intentionally places or attempts to place another person in fear of imminent serious physical injury.(b) Menacing is a Class B misdemeanor.

Reckless endangerment.
(a) A person commits the crime of reckless endangerment if he recklessly engages in conductwhich creates a substantial risk of serious physical injury to another person.(b) Reckless endangerment is a Class A misdemeanor.
