TheStatealsorequeststhattheCommissionsetasideitsOrderauthorizingtheJordanCoveLNGimportfacilityandassociatedPacificConnectorpipeline'basedonthepetitionsforrehearingandtheseadditionalfacts.Untiltherecordinaproceedingshallhavebeenfiledinacourtofappeals,theCommissionmaysetasideitsorderatanytime.15U.S.C.§717r(a).JordanCovestatesinitsapplicationtoDOEforauthorizationtoexportnaturalgasthatitintendstoapplytotheCommissiontoamendtheexistingauthorizationbymid-2012withtheexpectationthattheCommissionwillauthorizetheimport/exportfacilitybytheendof2013.TheCommissionshouldsetasidetheexistingOrderandaddressinaseparateproceedingonanewapplicationthepublicinterestofwhatwillbeessentiallyanewproposalforadual-use,import/exportfacilityandassociated
pipeline.'
TheStateofOregonsubmitsthatanewapplication,ratherthanarequesttoamendtheexistingauthorization,istheappropriateprocedure.

Goodcauseexistsbecausethefactsdemonstrateachangeincorecircumstancesthatgoestotheveryheartofthecase.TheheartofthiscaseiswhethertheJordanCoveLNGimportterminalisinthepublicinterestandthePipelineisrequiredbypublicconvenienceandnecessitypursuanttotheNaturalGasAct(NGA).TheCommission'sOrderreliesontheProjectprovidinganadditionalimportednaturalgassupplytothe

Asthepresentdocketshows,JordanCoveandPacificConnectorhavenotobtainedthenecessaryauthorizationstobeginconstructionoftheimportfacilityandpipeline,includingcertificationundersection401oftheCleanWaterActandconcurrenceundertheCoastalZoneManagementAct.ThefederallandmanagementagenciesareunlikelytoapprovetheextensiverightsofwayacrossfederallandsuntilJune,2013.LetterfromU.S.BureauofLandManagementtoPacificConnectordatedAugust2,2011,DocketNos.CP07-441-000andCP07-444-000,AccessionNo.20110901-0010(Aug.31,2011).Inaddition,asJordanCove'sDOEapplicationtoexportrecognizes,themodifiedfacilitydesigntoaccommodateexport,includingnewliquefactionfacilities,willrequirereviewundertheNationalEnvironmentalPolicyAct.Accordingly,shouldtheCommissionsetasidethepresentauthorizationtoimport,ampletimeexiststoreviewtheproposedimport/exportprojectinitsentirety.
