AREVIEWOFTHEPROPOSEDCHEROKEECOUNTYFARMLANDPRESERVATIONPROGRAMORDINANCETheproposedordinanceestablishesmanybenefitsforparticipatingfarmersandothercountyresidents.Thesebenefitsinclude:--Theprogram.preservesandmaintainsagriculturalareaswithinthecounty;--Theprograminformsnon-farmingneighborsandpotentiallandpurchasersthattheparticipatingfarmmayemitnoise,dust,andsmells(thisfeaturemayhelpavoidconflictsbetweenneighborsandpotentialnuisanceclaims);--TheprogramgivesthefarmingcommunityabettervoiceinCherokeeCountyCommisionersdecisionsaffectingfarmland;--Farmerparticipationintheprogramisvoluntaryandthefarmermayterminatehis/herparticipationatanytime;--TheprogramrequirestheCherokeeCountyCom-missionerstousefarmland"asalastresort"iftheyareattemptingtocondemncountylands;--Theprogramwouldprovidegreenspaceandnaturalresourcesasthecounty'spopulationanddevelopmentexpands.TheordinancedocumentcontainsseveralreferencestoNorthCarolinaStatutes.Anunderstandingofthesignificanceofthesestatutesisveryimportantasyoudecidewhethertojointheprogram.NCGS106-735through106-743providetheauthoritytotheCherokeeCountyCommissionerstoimplementaFarm-landPreservationProgramandestablishescriteriafortheprogram.NCGS105-277.2through105-277.7establishthepresent-usevaluetaxationprogramforqualifyingfarmland.NCGS121-35allowspartiestoenterintoConservationAgreements.Thestatutepermitseitherpartytoenforcetheagreementandthepartiescandeterminetheexpirationoftheagreement,whichunderthisordinancewouldbeatenyearperiod.Inaddition,theCherokeeCountyFarmlandPreservationOrdinancespeci-ficallyallowsthefarmertorevoketheagreementatanytime.
 
CHEROKEECOUNTYFARMLANDPRESERVATIONPROGRAM
ARTICLEITITLEThisprogram,adoptedbytheBoardofCommissionersofCherokeeCounty,NorthCarolina,shallbeknownastheCherokeeCountyFarmlandPreservationProgram.ARTICLEIIAUTHORITYThearticlesandsectionsofthisprogramareadoptedpursuanttotheauthorityconferredbyN.C.GeneralStatutes106-735through106-743.ARTICLEIIIPURPOSEThepurposeofthisprogramistopromotethehealth,safety,ruralagriculturalvalues,andgeneralwelfareofthecounty,andmorespecifically,increaseidentityandprideintheagriculturalcommunityanditswayoflife;encouragetheeconomicandfinancialhealthoffarming;increaseprotectionfromundesirable,non-farmdevelopment;andincreasetheprotectionoffarmsfromnuisancesuitsandothernegativeimpactsonproperlymanagedfarms.ARTICLEIVJURISDICTIONThejurisdictionoftheCherokeeCountyFarmlandPreservationProgramshallbetheunincorporatedareasofCherokeeCounty.ARTICLEVDEFINITIONSAdvisoryBoard:TheCherokeeCountyAgriculturalAdvisoryBoard.BoardofCommissioners:TheBoardofCommissionersofCherokeeCounty,NorthCarolina.Chairman:ChairmanoftheCherokeeCountyAgriculturalAdvisoryBoard.
 
District:AvoluntaryagriculturaldistrictestablishedunderthetermsandconditionsofthisprogrambytheBoardofCommissioners.ARTICLEVIQUALIFICATIONSANDCERTIFICATIONOFFARMLANDSection600.RequirementsInorderforfarmlandtoqualifyforparticipationunderthetermsofthisprogram,itshallmeetthefollowingrequirements:(1)Thefarmlandshallberealproperty.(2)Thefarmpropertyshallbeparticipatinginthefarmpresent-use-valuetaxationprogramestab-lishedbyG.S.105-277.2through105.277.7,orisotherwisedeterminedbythecountytomeetallthequalificationsofthisprogramsetforthin

S.105-277.3.(3)ThepropertyiscertifiedbytheNaturalResourcesConservationServiceoftheUnitedStatesDepart-mentofAgriculture,inconsultationwiththeCooperativeExtensionServiceandtheFarmServiceAgency,asbeingafarmonwhichatleasttwo-thirdsofthelandiscomposedofsoilsthat:(a)arebestsuitedforprovidingfood,seed,fiber,forage,timber,andhorticulturalcrops,includingChristmastreesandorna-mentals;(b)havegoodsoilqualities;(c)arefavorableforallmajorcropscommontothecountywherethelandislocated;(d)haveafavorablegrowingseason;and(e)receivetheavailablemoistureneededtoproducehighyieldsforanaverageofeightoutoftenyears.ORSoilsonwhichatleasttwo-thirdsofthelandhasbeenactivelyusedinagricultural,horticulturalorforestryoperationsasdefinedinG.S.105-277.2(1,2,3)duringeachofthefivepreviousyears,measuredfromthedateonwhichthedeter-minationmustbemadeastowhetherthelandinquestionqualifies.
