STATEMENT OF FACTS On Thursday, December 1, 2011, approximately 1035 hours, an unidentified subject entered into the Suntrust Bank located at 3440 Wisconsin Avenue Northwest, Washington, D.C., which is insured by the Federal Deposit Insurance Corporation (FDIC). While inside of the bank, the subject walked over to the check writing counter and reached into a nearby wastebasket. The subject withdrew a piece of paper and wrote something on it and then walked up to a teller station. The subject passed the note to the teller which stated: Shut the fuck up, I need $800.00 in large bills. The bank teller questioned the subject and the subject turned away and left the bank without obtaining any money. The subject also left the demand note behind. Witnesses described the subject as a b/m, 57, clean shaven (but with a black mole-type spot on the left side of his face), and wearing a brown or tan colored coat, a dark hat and carrying a black backpack. Video surveillance from the Suntrust Bank clearly showed the subject as being a black male, clean shaved with a mole or tattoo under his left eye and wearing a dark colored skull cap, a brownish colored coat, dark colored shirt, blue jeans, black shoes with a white sole, and carrying a black backpack with the product name Under Armour on one strap and the Under Armour logo on the other. On Tuesday, December 6, 2011, an article appeared in the Washington Examiner along with an image from Suntrust Bank surveillance. A witness saw the image depicted in the Washington Examiner and identified the subject as Theodore Parker who had been staying at the Father McKenna Center shelter for the homeless at #19 I (Eye) Street Northwest, Washington, D.C. That witness alerted a staff member at the center who informed a Special Police Officer (SPO) at that location. The SPO detained Parker and contacted the Metropolitan Police Department. Sergeant Hunter, Detective Carey and Detective Baylor responded to the scene and viewed Parker. Parker matched the physical description as described by the witnesses to include a tattoo under his left eye. Parker was wearing shoes that were similar to the ones depicted in the bank surveillance. Parker was also in possession of a black backpack with the product name Under Armour on one strap and the Under Armour logo on the other, similar to the one depicted in the bank surveillance video. Theodore Parker was placed under arrest based on probable caused and transported to the Metropolitan Police Department Headquarters for processing.

A photo array was created which included a photograph of Theodore Parker and five filler photographs. Parker was in position number two. The photo array was later presented to one of the witnesses of the attempted robbery at the Suntrust Bank at 3440 Wisconsin Avenue Northwest. That witness viewed the array for approximately 15 seconds, pointed to number two, and mumbled, This one right here. This comment was heard by one of the two investigators. The second investigator asked the witness what the witness had said and the witness then stated, Almost like this one.
