TotalE&PCanadaLtd
(TOTAL)isproposingtheJoslynNorthOilSandsMinedevelopment(theProject)innorth-easternAlberta.Theconstructionphaseisscheduledtobegininthewinter201112012withtheminingproductionphaseproposedtostartinearly2017andcontinueuntil2037.TheProjectisoneofseveralactualorproposedoilsandsdevelopmentsinthevicinityoftheAthabascaRiver,northofFortMcMurray,Alberta.InFebruary2006,TOTALappliedtotheAlbertaEnergyResourcesConservationBoard(ERCB),pursuanttoSections10and11ofthe
OilSandsConservationAct
andSections3,24,and26ofthe
OilSandsConservationRegulation,
andtoAlbertaEnvironment(AENV),pursuanttothe
EnvironmentalProtectionandEnhancementAct
andthe
WaterAct,
fortheconstruction,operation,andreclamationofanoilsandssurfacemineandbitumenextractionfacilitytobelocatedonthewestsideoftheAthabascaRiverjustsouthofCanadianNaturalResourcesLimited's(CNRL)HorizonOilSandsProjectandjustnorthwestoftheFortMcKayFirstNationcommunity.Theprojectconsistsofanoilsandsopenpitsurfacemineandorepreparationandbitumenextractionfacilities.
It
isdesignedtoproduceabout16,000cubicmetresperday(100,000barrelsperday)ofpartiallyde-asphaltedbitumenproduct(i.e.liquidhydrocarbon).Theprojectalsoincludestailingsmanagementfacilitiesincludingthreesandbeachareasforcoarsetailings,twodisposalareasforthickenedtailingsandapondforrecyclewater;on-siteenergygenerationinfrastructuretogenerateelectricityandsteam;waterinfrastructure,includingabankriver-waterintakesystemontheAthabascaRiveranda90dayoff-streamstoragepond;roadsandcrossings,includingahaulroadunderpassbeneaththeCNRLroadandassociatedutilitycorridorsforpowerlines,naturalgas,tailings,andrecyclewatertransportlines;on-siteinfrastructure,includingmaintenanceshops,administrationbuildings,engineeringandoperationsbuildings,andtheprojectcamp;materialstoragefacilities,includingexternaldisposalareasforoverburdenandinterburden,reclamationmaterialstockpiles;andothersupportinginfrastructure.TheprojectalsoincludestherealignmentofJoslynCreekandthedevelopmentofacompensationlake.AprogressivereclamationplanandclosureplanisalsotobeincludedaspartoftheProjectrequirements.TheERCBdeemedtheapplicationtechnicallycompleteinJanuary2008,andAENV
 
determinedthattheenvironmentalimpactassessmentwascompleteinFebruary2008.TheERCBwastheninapositiontomakeadeterminationregardingareviewoftheProjectbyapublichearingprocess.
FederalRegulatoryApprovals
TheProjectrequires:(i)AnauthorizationfromFisheriesandOceansCanada(DFO)undersection32ofthe
FisheriesAct
topermitthedestructionoffishbyanymeansotherthanfishing;anauthorizationundersubsection35(2)ofthe
FisheriesAct
toharmfullyalter,disruptordestroyfishhabitat;(ii)Anapplicationmadebytheproponentunderthe
NavigableWatersProtectionAct
forawaterintaketobeplacedintheAthabascaRiverwillbeconsideredbyTransportCanadaundersubsection5(3)ofthisAct.Anyandallimpactsofthewaterintaketonavigationwillbemitigatedbythesubsection5(3)approvalconditions.ThepossibilitythatDFOwouldbeaskedtoissueauthorizationsunderthe
FisheriesAct
requiredthatDFOensurethatanenvironmentalassessment(EA)wasconductedontheproposedprojectpursuanttothe
CanadianEnvironmentalAssessmentAct
(CEAAct).Therequirementforasubsection5(3)approvalunderthe
NavigableWatersProtectionAct
doesnotrequireTransportCanadatoconductanenvironmentalassessmentundertheCEAAct.
TheEnvironmental
AssessmentProcessTheEA,conductedpursuanttotheCEAAct,commencedonFebruary12,2008asacomprehensivestudy.OnMarch13,2008,DFO,astheonlyResponsibleAuthorityundertheCEAActfortheProject,recommendedtotheMinisterofEnvironmenttorefertheProjecttoaJointReviewPanelwithAlberta.OnApril28,2008theMinisterofEnvironmentreferredtheProjecttoaJointReviewPanel(thePanel)tobeconductedinco-operationwithAlberta'sEnergyResourcesConservationBoardhearingprocessandinaccordancewiththeCanada-AlbertaAgreementonEnvironmentalAssessmentCooperation.Otherfederaldepartmentsinvolvedinprovidingexpertadvice(i.e.FederalAuthorities)includedEnvironmentCanada,HealthCanada,NaturalResourcesCanada,andParksCanadaAgency.TheEAoftheJoslynNorthMineProjectwasconductedasajointfederal-provincialreviewpanelundertheCEAActandAlberta's
EnergyResourcesConservationAct
(ERCA).Underthistypeofreview,theMinisteroftheEnvironment(throughthe
