We will try to resolve your disagreement with our decision through the post-decision reviewprocess. A member of our Fiduciary activity will review the decision.
HOW DOES THE POST-DECISION REVIEW PROCESS WORK?Complete review:
A member of the Fiduciary activity will review the materials in your VArecords, including evidence, statements and arguments pertaining to the selection of your current fiduciary. The individual reviewing your case may seek additional evidence fromyou or some other source. You may be asked to participate in an informal conference.
New decision:
You will be notified of the decision resulting from the review and of your appeal rights. If VA decides to select a different fiduciary,
 
you will be contacted by amember of the Fiduciary activity, who will facilitate a change of fiduciary.If we cannot resolve your disagreement, we will send you a Statement of the Case (SOC),which is explained below.
WHAT IS A STATEMENT OF THE CASE?
If we cannot resolve the disagreement through the review process, we will prepare anSOC and send you a copy. The SOC will include a summary of the evidence, a citation topertinent laws and regulations, a discussion of how those laws and regulations affect thedecision, the decision, and a summary of the reasons for the decision. If you do not agreewith that decision and wish to continue your appeal, you will need to submit a substantive
